Does Lufthansa have to rebook passengers when flights fail?
Passengers are entitled to rebooking under EU law. It is also possible that passengers will be booked on other means of transport if the destination is accessible by bus or train.
Which rules apply to package vacationers?
The tour operator has to look after an alternative promotion. From a delay of more than four hours at the destination, holidaymakers can also reduce their travel price later proportionately. Is affected persons entitled to compensation?
Whether passengers are entitled to compensation for flight cancellations in a strike is legally controversial. The Federal Court of Justice (BGH) found in 2012 that a pilot strike is an exceptional circumstance. The consequence: The passengers affected by delays and cancellations did not receive any compensation (Ref .: X ZR 138/11, X ZR 146/11). However, the airline has to do everything in its power to minimize the consequences of the strike. Lufthansa has announced that it will work on a special timetable.
The European Court of Justice has ruled that an airline in a wildcat strike can not easily cite exceptional circumstances (Ref .: X ZR 111/17). So far, however, this judgment is not necessarily transferable to regular strikes - the ECJ still has to clarify that.
