The case dates back to November 18, 2018. The day before, the movement of yellow vests came out for the first time in the street.
The start of a social and political earthquake.
“To strike a big blow and hurt the economy, blocking Amazon warehouses.
The week of Black Friday begins tomorrow and it is still the most well-off who will benefit from it ”, then launched Rémi D., an Amazon employee in a branch of Loiret, in Saran.
For this text, this 37-year-old man was laid off three days later and then dismissed for serious misconduct.
Two years later, the industrial tribunal ruled in his favor against the multinational, reveals Liberation.
No real and serious cause has been given to justify this dismissal.
This message did not really target Amazon as such but "the economic system and social inequalities", according to the court.
In addition, it was published "in a national passionate context initiated by the yellow vests group".
At the time, at least three other workers in favor of the movement were dismissed for similar reasons.
All were accused of having breached their "contractual obligations" and therefore of having shown disloyalty.
Amazon did not want to reinstate it in April 2019
“Speaking of blocking, I meant to call a strike.
I acted out of anger, ”Rémi D. defends himself since the fall of 2018, observing that this message had no impact and that it was neither shared nor commented on.
His message was posted on the Facebook page "We yellow vests", followed by tens of thousands of people.
“This message can be interpreted as a call to strike, with strike leading to blockage.
And it is impossible to dismiss an employee for calling a strike, ”added his lawyer Avi Bitton.
The court awarded Rémi D. 21,500 euros, not including legal costs.
Note that in April 2019, the young man had asked to return to the company during a conciliation before the prudhommes.
What the employer had refused.
It remains to be seen whether Jeff Bezos' firm will appeal.
