Amir Bramley was convicted this morning (Thursday) of investor fraud amounting to NIS 340 million, and the judge sentenced him to 10 years in prison and a fine of hundreds of thousands of shekels, but many believe that the punishment he received is too light in relation to the offense he committed.

Adv. Shashi Gaz, a criminal law expert, expressed his opinion on the matter and emphasized that in relation to other rulings, this is a particularly severe punishment.

"This is one of the most serious cases in Israel in terms of the extent of the fraud," said Adv. "One of the most severe punishments in Israel. In the United States, more severe punishments are given, but if you try to remember Israelis who received this kind of punishment for financial fraud, you will not find."

"Such property offenses do not receive such severe penalties in Israel," stressed Adv. Gaz.

He wanted to disqualify the judge and used all sorts of tricks, which did not add to his sentence.

"" The prosecutor's office demanded a sentence of between 12 and 16 years in prison in addition to compensation of NIS 5 million, "said Adv. Gaz.

"The prosecution always asks for much more than the punishment they actually receive. I am sure that whoever submits the appeal to the court will be Bramley, and not the prosecution."

Later, Advocate Shashi Gaz explained why people who invest their capital take a risk, and addressed the difficulty of understanding whether it is a legitimate investment or a financial fraud: “There is a big difference between a person who intended from the beginning to cheat, and a wrong investment that people made.

If a person who has invested his money loses, it does not make the man who took his money a criminal offender.

When you go to invest money you take a risk.

The line between unwise investment and criminal investment is a very delicate line. "

The State Attorney's Office's response to the sentence

Advocate Hannah Korin from the Securities Department of the Taxation and Economics Prosecutor's Office, who handled the case, said at the end of the hearing: "The sentence imposed today on Amir Bramley is a significant sentence that expresses a strict approach to fraud in the capital market.

Bramley deceived investors by guaranteeing them high and risk-free returns, and in effect transferred the funds for investment in high-risk ventures, paying the guaranteed interest rates from the investors' own money.

Bramley acted unsupervised, violating the obligation to publish a prospectus.

A court has accepted the prosecution's position that an important message should be sent to any entrepreneur who believes he can raise funds from the public without responsibility, ignore the obligations imposed on him, and undermine the trust of investors who pass on their best savings to him.

At the same time, the punishment imposed is lower than the position we presented, and we will study the sentence. "
