Emmanuel Macron's announcements: systematized teleworking, what does it mean?

2021-04-01T04:28:43.828Z

Head of State Emmanuel Macron urged French people who can to telework. But this injunction will prove to be complex to put

In his speech, Emmanuel Macron calls on companies to "systematize teleworking", and this throughout the territory.

"And I call on all workers and all employers to use it, whenever they can," added the Head of State.

The semantics change but the substance remains the same.

“We don't move anything.

The rule for teleworking for those whose tasks allow it is five days, ”recalls the Ministry of Labor.

This is one of the mantras of the fight against Covid in business, with barrier gestures, hammered at each turn of the sanitary screw to slow down the mad rush of the coronavirus.

Obligatory ?

While many labor lawyers dispute it, by including teleworking in the arsenal of measures to be taken as part of the employers' obligation to ensure the health and safety of their employees in the event of Covid, the executive de facto makes it obligatory.

During a control of the labor inspectorate, recalcitrant employers risk a formal notice for endangering employees.

As for the day called "valve", it is maintained.

It is the possibility offered to employees who suffer from isolation or psychological difficulties to come to their office, on site one day a week, with the agreement of the employer.

Élisabeth Borne, the Minister of Labor, has been repeating it for weeks: there is significant room for improvement in teleworking, in the public as well as in the private sector.

According to the latest ministry study conducted in mid-March, 35% of workers who could telecommute because their activities allow it, still do not.

The number of working days away from home fell from an average of 3.7 days last November to 3.4 in March.

"And the brakes are not always only on the side of the employer," confirms the Directorate General of Labor which is currently increasing the checks, especially in Île-de-France.

Children at home.

And the parents ?

For four weeks working parents will have to manage the children at home.

Unlike the first confinement, the devices planned to help them are not legion and more stringent.

No more work stoppages for childcare issued by the security, and which allowed to be compensated as for a sick leave, by the Cnam.

Since May 1, 2020, all parents unable to work have had to switch to partial unemployment.

Conditions which were modified in September 2020. To benefit from the partial activity, both parents must be unable to telework.

The child must also be under the age of 16, or be disabled without age limit.

The employee will have to provide a sworn statement to his employer indicating that he is the only one of the two parents requesting to benefit from a work stoppage in respect of the custody of his child.

The steps will be taken by the employer, who will have to make a declaration on the government website dedicated to the partial activity where he will declare his or her employees who look after their children.

From next week, as soon as the request is made to the company, the employee will be supported and compensated up to 84% of his net salary or 100% if he is at the minimum wage.

The employer will have to cover the rest, said Labor Minister Élisabeth Borne on Tuesday.

Faced with the complexity of the situation of partial activity for working parents, the Minister of Labor will open a video consultation this Thursday with the social partners.
