The reform of the Monotax Law that
eliminates the retroactive increase
that taxpayers had to pay and that generated a strong discomfort was enacted this Thursday through its publication in the Official Gazette.
Through
Decree 480/2021
, which bears the signatures of President Alberto Fernández, the Chief of Cabinet, Santiago Cafiero, and the Minister of Economy, Martín Guzmán, the rule was promulgated that also promotes the implementation of
a payment plan of 60 installments
for debtors.
The initiative began to take shape when, at the beginning of last month, the AFIP retroactively updated the new scales and categories, and
recategorized more than 4 million people
.
This caused taxpayers who had already paid in a timely manner to be generated a debt for
a 35% increase
in the amounts between January and May.
Faced with the strong claims, the Government backed down with the update and last week the Senate approved a modification of the Monotributo Law.
The initiative promoted by deputies Sergio Massa and Máximo Kirchner establishes that the scales for the first half of the year maintain the values of December 2020, without the retroactive increase of 35%.
But as the approval of the latest changes was delayed, the AFIP had to extend the period to recategorize, first until July and now until August 17.
"We extended the recategorization to the month of August so that monotax holders can benefit from the billing limits established by the new law," explained the head of the AFIP, Mercedes Marcó del Pont.
Recategorization will be enabled
from July 28 to August 17
and, on the other hand, until August 27, the payment of the monthly obligation for that month may be made.
Thus, the category change will occur simultaneously with the new billing thresholds established by the new law.
The head of the AFIP also detailed news regarding the moratorium.
"There will be rates for
lower categories of up to 60 installments of 1.25%
, the project said up to 1.50% and then they will be higher for the highest categories," explained Marcó del Pont.
This benefit will be in force once the rule is regulated and the same will happen with the other modifications.
For example, those who have a debt may enter the moratorium and those who at some point left the monotax for having billed over the limits may return to the regime.
With this reform, the Fiscal Strengthening and Relief Program for Small Taxpayers is created to complement the Tax Support and Inclusion Regime for Small Taxpayers.
The Government thus seeks to give "
greater fiscal relief and predictability
to the economic activity of monotributistas", which add up to a total of 4,080,151 taxpayers;
of which 1,592,466 (39%) are in the Metropolitan Area of Buenos Aires (AMBA) and 2,487,685 (61%) in the rest of the country.
The initiative also establishes that those who exceeded the expected turnover in their category may remain in the scheme as long as they do not exceed the annual turnover of $ 5.55 million and a net worth of up to $ 6.5 million.
Marcó del Pont indicated that he expects "to have
the regulation" of the reform
ready
by Friday or Monday
at the latest, which according to his interpretation, "entails fiscal relief for debt forgiveness, for the moratorium and money laundering for those who they were excluded. "
