Starting next Wednesday, September 1, Uruguay will enable the entry into the country of foreigners who are property owners and who prove to be vaccinated against COVID-19, including their relatives up to the second degree of consanguinity.
"The Executive Branch published Decree 279/21 on Friday, which establishes an additional exception to the partial closure of borders currently in force, enabling the entry into the country of foreigners who are property owners and holders of social participations or shares of legal persons and final beneficiaries of real estate located in the country, who can prove that they are immunized against the COVID virus, ”explains Ricardo Domínguez, head of Rica Consultores, who specialize in tax and legal residence procedures for foreigners in Uruguay.
Among those authorized to enter, the decree includes the owner's spouse or common-law partner, children, parents, grandparents, siblings and grandchildren.
However, there are a number of issues that are still not entirely clear, according to the consulting firm.
For example, the regulations do
not include kinship by affinity, such
as that which links one spouse with the blood relatives of the other, such as in-laws, daughter-in-law and brothers-in-law.
“We must also analyze the property situation of a person who acquired the property as a community of property, but titled in the name of a single spouse, what happens to the relatives of the person who does not have the property in their name.
Although the text does not expressly include it, they should also be considered included ”, says Domínguez.
Requirements to enter Uruguay
To enter the neighboring country, the requirements will be the following:
* The owners must present a
Notarial Certificate issued by a Notary Public in Uruguay
or make an
affidavit
of the assets in Uruguay.
2. Cases in which the owner of the property is a
legal person
are contemplated
.
Thus, the entry of individuals who appear as partners of companies, shareholders and in the case of final beneficiaries arising from the declaration filed with the corresponding Central Bank of Uruguay is enabled.
3. The owner of the property and their relatives to enter
must demonstrate that they are immunized with a vaccine against COVID
either one or two doses according to the type of vaccine, approved by their country of origin, within the last six months prior to shipment or arrival in the country and complying with the respective waiting periods to achieve effective immunity.
It is logical that even the
combination of vaccines
from different laboratories
is admitted
, provided that it is proven to have received the corresponding doses and completed the period of effectiveness to achieve immunity, and
without the age being greater than six months.
4. In the case of foreign citizens
under 18 years of age
, who come from a country in which no type of COVID vaccine has been approved for their age group, they
must comply with the preventive isolation of 7 days
plus a negative swab or 14 days of quarantine, and
his family must keep the same isolation
that the minor has done.
5. All must
certify a PCR test with a negative result prior to traveling
, and it will not be necessary for them to quarantine, except if they are admitted with unimmunized minors under 18 years of age, in which case, all members must carry out the corresponding quarantine.
6. It is important to have the
forms of affidavits
to prove: owner, partner or shareholder or final beneficiaries of real estate in Uruguay and accreditation of people who are immunized from COVID by the application of one or two doses as appropriate.
"It is worth mentioning that until now the opening of borders has not been established for those immunized foreigners who enter Uruguay after November 1, 2021. Obviously the government is awaiting the evolution of infections and the development of the new Delta strain", Domínguez adds President Luis Lacalle Pou had promised to carry out this opening and if nothing adverse happens, it is estimated that it will happen.
