The Family Court rejected an objection submitted by a son to the execution of his late mother's will, which she made three months before her death (and a few months after her husband's death), in which she bequeathed all her property - which includes a residential building with several apartments and some savings - to her daughter (the objector's sister), and excluded him from the will altogether.

In the son's objection to the execution of the will, he claimed that the will was illogical and unreasonable because he and his mother had a close and warm relationship, and because this will was preceded by a mutual will made by the deceased and her late husband 16 years before, which was not changed during all the years, until the making of the current will.

The son also claimed that the deceased was not qualified to make a will and that she was "easy prey" for the unfair influence exerted on her by his sister, who incited their mother against him.

The sister, who was represented in the proceedings by attorneys Yuval Adler, Hali Dankner-Cohen and Luna Halon, from Ben Ari, Fish, Saban & Komisar, claimed that the will reliably reflects the will of their deceased mother, and that the will is the result of his "bullying and disrespectful" behavior " of the son towards his parents over the years, and due to the heavy duties owed by her brother to their deceased parents, Shabatim saw the deceased as someone who had already received his share in life.

As evidence of this, the lawyers submitted during the proceedings the mobile phone of the deceased, which was held by the nurse. In recorded conversations And in voice WhatsApp messages that were found on the phone, the deceased was heard blaming the son for the death of her late husband, slamming him for causing her own death as well, demanding that he return the many funds he took from her over the years, which amount to millions of shekels, begging him to pay attention to her requests, to stop ignoring her, Let him stop being indifferent to her plight, and later an explanation will also be heard from her mouth, directly to the son's ears, why she decided to revoke her will.

In a reasoned ruling, the court completely rejected the son's claims, and stated: "I believe that this is an idle proceeding, which it is doubtful whether there was any room for its administration in the first place, and for this reason I also found that legal costs should be charged against him."
