The Federal Constitutional Court has dismissed a complaint by seven FDP members of the Bundestag against a law amending the ESM euro rescue fund as inadmissible.
The plaintiffs did not sufficiently explain why their rights should have been violated, the court explained on Friday in Karlsruhe.
They also did not explain why the changes would transfer sovereign rights to the ESM or the European Union (
Az. 2 BvR 1111/21
).
This allows Federal President Frank-Walter Steinmeier to sign the law.
At the request of the highest German court, he suspended the examination in the summer of 2021.
The ESM rescue fund is intended to protect the euro countries.
With the reform, the currency area wants to better arm itself against future financial crises.
This includes a common safety net for the settlement of bankrupt banks.
From the point of view of the FDP MPs, the approval law should have been passed in the Bundestag and Bundesrat with a two-thirds majority.
They had declared that they did not fundamentally question the ESM, but rather saw their rights violated.
