The Hamburg Office for Migration has overlooked an arrest warrant against an Afghan who has already been deported from Germany and returned.
An "individual error in the processing" was made, said a spokesman for the office.
Accordingly, the man came to the central reception center on February 9 and wanted to apply for asylum again.
The authorities found that he had already applied for asylum in Munich and referred him there.
The wanted notice in the central register of foreigners – the pending arrest warrant could have been noticed there – was not taken into account.
Flew to Kabul in 2019
The federal police arrested the 24-year-old in Hanover on the same day when he was caught there without a ticket, as reported by the "Bild" newspaper.
In 2018, the district court in Munich had sentenced him to two and a half years in prison for raping a 16-year-old student.
In August 2019, he was flown to Kabul before the end of his sentence.
According to the report, the District Court of Neuburg an der Donau subsequently issued an arrest warrant in September 2019 as a precautionary measure in the event of his re-entry.
In such a case, he could have been taken to the nearest prison for further execution.
