The Tar of Liguria has decided to transmit to the Constitutional Court the question of Autostrade against the Genoa decree that has ousted it from the demolition and reconstruction of the Morandi bridge. In the meantime it has suspended the judgment on the appeal of Aspi on the cancellation of the same decree. This was decided by the judges of the regional TAR according to what emerges from the orders filed this morning. The judges found profiles of unconstitutionality. Aspi had given up blocking jobs. In detail, five ordinances of the Tar of Liguria were filed on the judgments proposed by Autostrade per l'Italia and Pavimental for the annulment of the deeds relating to the reconstruction of the viaduct on the Polcevera collapsed on August 14, 2018. "Although we can not believe that the 'provision-law' is in itself incompatible with the set of powers established by the Constitution, it must observe general limits, including the principle of reasonableness and non-arbitrariness ", stated the sentences.
