While President Trump has continued to lower his profile since the violent riots on Capitol Hill, Democrats appear determined to create momentum and complete the first part of the impeachment process they are initiating as early as this week, though it is unclear if this is constitutionally possible.



House Speaker James Claiborne, a senior member of the Democratic faction, told CNN yesterday that the party intends to bring to a vote in the plenum as early as Tuesday or Wednesday the wording of the indictment for "incitement to rebellion."

However, he estimated that the charges would be filed in the Senate only a few months after Trump left office on January 20.

Lawyer Alan Dershowitz stressed in an interview with i24NEWS yesterday that there is no reason to use the impeachment mechanism against Trump because the courts have already ruled that the president and others have freedom of expression as long as they do not call for explicit violence.

Dershowitz also warned that a dismissal procedure based on things Trump said at a political rally would be a dangerous precedent that would constitute "a loaded weapon to be used in the future, and that was not the intention of the constitution."

Moreover, he said the constitution does not allow for a trial for the president after his tenure.

"The constitution explicitly refers to a scenario that the president is removed from office, it does not refer to a former president," he said.
