The judge in chambers of the Council of State rejected Thursday, December 22 a request filed by an association of magistrates of the court of Nanterre and by the bar of Hauts-de-Seine to challenge "
the circular of location of jobs
" of the Keeper of the Seals , which determines the number of magistrates allocated to a court.
The magistrates and lawyers of this department of the Paris region asked, with this request filed in November, that additional magistrate posts be thus allocated to the court of Nanterre.
At a press conference last month, they described the “
catastrophic situation
” of the court, calling on the Chancellery to take into account the “
specificities
” of their jurisdiction, which “ is
awash in particular with litigation from La Défense companies.
and “
cannot in fact be treated as an ordinary court
”.

If "
the administration does not dispute the excessive nature of the delays in judgment at the Nanterre judicial court
", "
it is not up to the urgent applications judge of the Council of State to replace the assessment of the finance law as to to the determination of the total number of judicial magistrates in office
”, noted the highest administrative court of France in its decision, consulted by AFP.
“
We see in this motivation signs of recognition of the dramatic situation in Nanterre
,” reacted to AFP the president of Hauts-de-Seine, Isabelle Clanet dit Lamanit.
“
It seems to us that the reasons for the decision can be interpreted favorably because the judge recognizes that the excessive nature of the delays in judgment is not disputed by the administration, as well as the serious difficulties affecting the court.
This decision seems to me to be able to be usefully mobilized within the framework of the appeal on the merits
” which was filed in parallel before the Council of State, she added.
