For weeks there was irritation about his passport, but now it is clear: Rudolph Moshammer's murderer is to be deported shortly.

Herish A. (43) has been behind bars for the crime for 18 years.

He now has to return to his home country of Iraq.

The minimum serving time of his prison sentence after 18 years expired on Sunday.

And after there had recently been irritation about his passport, there is now clarity: “Iraq has recognized Mr H.'s identity.

The State Office for Asylum and Repatriations now has the necessary passport replacement paper (PEP),” says spokeswoman Laura Arneth when asked.

"Now we are in close cooperation with the federal police, the judiciary and the Iraqi authorities to organize and carry out a timely return flight for the person concerned." Herish A. could be deported in the next few days.

On January 14, 2005, he strangled Rudolph Moshammer with a telephone cable in his Grünwald villa.

The Munich II Regional Court had sentenced the Iraqi to life imprisonment for murder.

In addition, the particular severity of the guilt was determined.

In 2020, the sentencing chamber of the Straubing district court set the minimum period of service at 18 years.

The Munich I public prosecutor had also spoken out in favor of deporting Herish A.

According to Section 456a of the Code of Criminal Procedure, a prisoner is no longer prosecuted after being deported to his home country.


Herish A. has wanted to return to his native Iraq for years.

"His family lives there," says his lawyer Adam Ahmed.

He confirms: “I assume that the identity has now been clarified and that the deportation will now take place.

That's why I withdrew the application for release from prison in Germany, especially since he wants to go to his home country and this goal is now being realized after the promise from the office."

According to tz information, Herish A.'s deportation is imminent.

Ahmed says: "If he is not deported within the next two weeks, I would submit the application again."
