Hérault: a nursing assistant accuses gendarmes of violence during an arrest

2020-06-13T00:00:57.389Z

A preliminary investigation was opened Tuesday to shed light on the arrest. Motorist and Cst versions

The images of this wound crossed by 60 stitches, now sinuating the skull of Abdelali L., have what to shake. This 35-year-old caregiver, who also wears an arm in a sling due to a broken collarbone, filed a complaint against members of a gendarmerie patrol, whom he accuses of having raped him, in the night from 21 to 22 May in Baillargues, in the Hérault.

The Montpellier prosecutor's office opened a preliminary investigation on Tuesday of the heads of "violence by persons responsible for public authority committed in meetings", reports La Dépêche du Midi. The magistrate will have to shed light on the circumstances of the arrest of this former soldier, who officiates in an Ehpad in Hérault, while his version and that of the gendarmes differ in several points.

"They want to puncture my tires"

Near the Parisian, Me Valérie Soulié, the lawyer of Abdelali L., explains that the evening of May 21, shortly after 11 pm, his client leaves his work and starts by car the 43 km which separate him from the home of his big -mother, whom he must join in Vauvert. He would have stopped during the trip in the parking lot of a supermarket in the town of Baillargues, almost halfway, in order to pick up his phone. It was there that a patrol composed of four soldiers carried out its control. The version given by them is quite different. “The gendarmes intervened for a race between two cars on the A9. They intercepted one of the two vehicles outside the motorway, "explains the gendarmerie, adding that the cars were traveling at" around 215 km / h ".

They are convinced that Abdelali L. is one of the two drivers, which he denies, even assuring never having taken the A9 that night. In a video that we could see, taken by the caregiver from his car during his check-up, we can hear the thirty-something, who films the faces of the soldiers, shout: "They want to puncture my tires, because supposedly they m 'checked in speeding […] They make fun of me, they put me down ”. "They don't want to let me go," he also laments, saying they have "no evidence" against him. In these images, we can see that two of the gendarmes are equipped with harrows, allowing the immobilization of a vehicle by piercing its tires.

The gendarmerie, according to whom the caregiver tried to flee the car park, confirms this use. “The driver does not recognize the offense, objects to its immobilization and wants to leave. The gendarmes then use a harrow and the person comes out of the vehicle, brandishes his phone towards one of them and is going to rebel, ”we are assured. "The gendarmes will control him and he falls to the ground, along with another gendarme, who will also be injured," also describes this source, who deplores the injuries of Abdelali L.

Emergency surgery

For his lawyer, who criticizes the action of "two particularly vehement gendarmes", the story of this fall is quite different. "They took out the portcullis, we are starting to get to know him. My client feels threatened, so he takes his phone and starts filming, then he takes a flashlight, his phone drops, he bends down to pick it up and we make him a ventral tackle ”. Me Valérie Soulié, who says she is "stunned" by the allegations of rebellion targeting her client, describes her injuries: "A hematoma on the head, a broken collarbone and a swollen ear. The caregiver was first placed in police custody in the premises of the Poussan brigade, before being hospitalized in Sète, around 2:40 am. His lawyer deplores this lapse of time, when the young man asked, according to her, to see a doctor several times. He is said to have vomited and suffered several illnesses in police custody.

After 24 hours of hospitalization in Sète, Abdelali Labroumi was transferred to the Montpellier University Hospital and operated on May 23, to reduce his hematoma, then a second time on the 29th for his collarbone this time. According to a document that we were able to consult, the doctor who met him when he arrived in Montpellier notes a "consciousness disorder" and an "extradural hematoma" in the head which "requires emergency intervention", as well as 'a clavicle fracture' and several hematomas. Abdelali L., who was prescribed 45 days of ITT by two doctors, spent six days in hospital.

Injury from a chest tackle or a fall? The man, described as "peaceful" by his lawyer, waits until the investigations, which have been entrusted to the Research Section of the gendarmerie of Nîmes, can shed light on this eventful evening of May 21. "If there is the slightest doubt about a possible fault on the part of our staff, the IGGN (General Inspectorate of the National Gendarmerie) may be seized," comments the gendarmerie for its part.
