Avishai Ben Haim responded to Deri's verdict with a racist claim. We didn't really expect anything else - voila! culture

Probably someone framed Aryeh Makhlof D, since one day he was disqualified for no wrongdoing.

With all his knowledge of human nature and the life experience he acquired during his time in politics and in prison, Aryeh Makhlouf D. did not believe that the day would come when serial offenders who were convicted three times of serious criminal corruption would be prevented from receiving another round at the public purse.

It probably happened in the dark.

In bad faith they determined that it was unlikely that the fattest cat in the yard would be appointed to guard the cream.

Something was shaken yesterday in the basic belief of Aryeh Makhlouf D., according to which commitments in a court have no meaning, that the purpose of laws is to protect the powerful, and justice is nothing more than the name of a star that is taught about in the schools of those from the empty wagon.



The news broadcasters yesterday on all channels were dramatic as if life had been discovered on Mars, or at least a cure for cancer had been found.

In reality, a total of 10 judges decided that a serial criminal cannot serve as a minister in Israel, certainly after he received a lenient plea deal and declared before a (different) court that he would retire from political life.

Reporters who covered the affair in foreign media, those who come from advanced democracies, failed to understand what the Big Fucking Whoop is.

That's probably the whole story.



While the High Court of Justice continues to present some level of logic in the midst of the madness, the local media long ago lost themselves in the political trolling imposed on us by years of political floundering imposed on us by another criminal defendant. The journalists who already feel the government's sword on their necks are more careful with their decisive words in the case the best, or lose every bit of respect for the profession in the worst case.

Avishai ben Haim, for the avoidance of doubt, does not need to worry about his servant.

In an age where it is more important for the new releases to sell entertainment than credibility, sweet Abishi will have a place in the panels under any regime, however extreme.

And so, ten minutes after the verdict was handed down, and before he had time to read even a sentence of the reasoning of the Supreme Court justices, he already determined that Netanyahu would be able to lead lightning legislation to cancel the reason for reasonableness - something that would make the verdict in the Deri case irrelevant anyway.



This is of course not true.

Not that the truth is important in these broadcasters, but it is important to explain: even if the cause of reasonableness is eliminated, Deri's verdict will remain intact, because five of the judges ruled that Deri is disqualified from being a minister in the government regardless of the question of reasonableness, on the grounds of judicial silence.

Again, it sounds complicated, but it's actually a pretty simple principle: a person can't say one thing in court, then go to another court and claim something opposite.

This is exactly what Deri did in this case according to the judges.

This is a doctrine so basic in the world of law that there is no chance that even a person like Yariv Levin will work to change it.

Although in his case it might be better to just not give him ideas.



In fact, Levin's opponent turned out in retrospect to be a kind of particularly schlumpy James Bond villain.

One who explains to Agent 007 how he is going to execute him, then walks out of the room and leaves him alone to free himself.

And so, after the Minister of Justice explained to the whole world his plan to cancel the reasonableness ground, the judges decided to simply disqualify Deri on another ground.

It turns out that the Supreme Court also deals with poetic justice.

The matter of "plausibility" came up again and again in the studios, even though at a fairly early stage it could be understood that it was irrelevant.

For example, Channel 13's political reporter, Moriah Asraf Wahlberg, who simply decided to repeat word for word the false claims that appeared on the coalition's message pages that the judges did not bother with the question of whether the appointment was legal or not, but ruled based on the reason of reasonableness alone ("What is reasonable in the eyes of one is not Reasonable," she clarified) - something that, as mentioned, turned out to be simply not true.



The one who became the darling of the right for a little while was Judge Yosef Elron, who was the only one of the 11 judges who did not agree with the decision to disqualify Deri.

Except that Elron really did not state that Deri can serve as minister, but rather that there is nothing at all to discuss the plausibility of his appointment, before the confirmation of his appointment is received by the election committee.

It took time for all the commentators in the various studios and websites to understand Elron's ruling (we mention Avishai Greenzweig who summarized the matter in Globes in a clear commentary column that is also accessible to laymen).

The reason for this is simple: in order to understand the ruling, you must first read it.



Those who watched the Channel 13 panel could see Baruch Kara wearing reading glasses and simply going through the judges' reasoning on his phone.

This, in fact, is what a journalist's job looks like most of the time.

We've gotten used to seeing Ron Ben Yishai and Itai Engel enter battle arenas with helmets and helmets, or Edva Dadon chasing crooks and yelling at them - but the true poetics of journalism is a legal commentator who sits in front of a complicated ruling and tries to understand it, in order to mediate it in a form Reliable and true to his viewers.

Ben Haim's face was shocked, he didn't really expect someone to respond matter-of-factly to his claim, and prove that not only is she racist - she is also simply factually incorrect.



Here perhaps this is also the opportunity to remind Ben Haim that the landscape pattern of Esther Hayut's homeland is from Shubaki Pass, where the movie "Salah Shabbati" was shot.

Indeed, her attitude towards the weaker sections of Israeli society is evident in her court rulings.

And the fact is, when one of the most powerful men in Israel is standing in front of her, who committed a crime again and again and again during his terms as an elected official - she does not judge by the color of his skin or the country of origin of his parents - but by the most basic human logic, the one that is clear to every child, whether he grew up in a kibbutz or a housing estate.

He has no ability to cover the story in a matter-of-fact way.

Avishai Ben Haim, of course, continued to appear on the many panels of Channel 13, as an expert on the Shas party in general and Aryeh Deri in particular (what comes comes comes) - but proved time and time again that he has no ability to cover the story in a matter-of-fact and objective way. This is evident in the words he chose to say. For example, he explained that the ruling is "proof of everything we claim," as if he were the spokesman for the party and not a journalist covering it. Later he returned and explained that it is more important to him to be a minister, to Derai it is important to be in the cabinet because that is what Rabbi Ovadia would have wanted.



This is an interesting claim, especially because the last time we heard Rabbi Ovadia speak in his own voice about Aryeh Deri, it was on a tape from 2008, when he was recorded explaining to his son why he would not return Deri (whom he calls on the tape, "evil") to the head of Shas. The video, exposed in 2014 by a colleague of Segal, caused an uproar mainly because of the words used by the spiritual leader of Shas on Deri such as "thief" and "bribe taker", while he calls Eli Yishai "honest".

Those who listened attentively to his words, understood that the main reason he does not want to return him to the party is that "Deri is too independent", and he does not always obey his words.

Apparently Ben Chaim, who is de facto a doctor of Rabbi Ovadia's affairs, simply forgot about all of this.
