A thirty-year-old man was found guilty of killing his partner's five-year-old son in January 2021 in Olivet (Loiret) and was sentenced on Wednesday to 23 years of criminal imprisonment by the Loiret Assize Court.

The sentence imposed was accompanied by a two-thirds security period.

A sentence of 25 years was requested.

“We have a stepfather who beat up for several weeks before this fatal episode of violence that caused Dayen’s death.

We are therefore not here in the unfortunately classic pattern of these parents who, in cases of shaken babies (…), lose their temper,” said the general counsel, Éléna Chevallier, during her indictment.

Described as non-violent by many of his relatives and a loving father by his ex-partner, the accused always mentioned a fall of the boy in the bathroom to explain the child's fatal injuries.

For the attorney general, the fall is “a story which is not that of the medico-legal expertise, which is not that of the witnesses”.

“I would never have imagined that”

On January 16, 2021, the man asked his neighbors for help, carrying the inanimate child to their landing.

Initially indicted for failure to report a crime, voluntary abstention from preventing a crime or misdemeanor and violence against a minor, she was released from all responsibility by the courts.

It was when I was in police custody that I understood,” she said, in tears.
