“Slip of the tongue” according to the imam concerned versus “calls to hatred” according to the Gard prefecture.
Launched by remarks made during a sermon broadcast on February 9 on Facebook, the controversy concerning the Tunisian imam of the Bagnols-sur-Cèze mosque (Gard) continued this Tuesday, February 20 through the media.
Holder of a residence permit which the Minister of the Interior, Gérald Darmanin, requested to be withdrawn “with a view to his expulsion from the territory”, Mahjoub Mahjoubi, almost 52 years old, defended himself on France-Bleu Gard-Lozère for having spoken of the “tricolor” flag (he would have meant “multicolored”) as a “satanic flag”.
“There are several tens of minutes of sermons which have been analyzed and contain many things other than this pseudo-lapse”, retorted on franceinfo the prefect of Gard, Jérôme Bonnet.
Concretely, what about the procedures concerning it?
Two components – one administrative, the other judicial – are engaged.
In terms of withdrawal of the right to stay with a view to expulsion, “all scenarios are being studied”, the Gard prefecture indicated this Tuesday.
In theory, explains the lawyer specializing in immigration law Stéphane Maugendre, three paths are possible: a ministerial expulsion order “which presupposes an absolute emergency that must be characterized”;
a prefectural order to “degrade” the residence permit prior to an obligation to leave the territory (OQTF) or a referral by the prefect of the departmental expulsion commission (Comex) — it is chaired by a judicial judge but his opinion is not does not bind the administrative authority.
