The US court approved a class action lawsuit filed against Apple alleging that the AirTag, its smart tracking tag, was poorly designed and allows for misuse for harassment. In the lawsuit, which was first filed in December 2022, the plaintiffs accuse the technology giant of "launching the -AirTag in a hurry and without sufficient protective measures to prevent the use of the product for surveillance purposes." The lawsuit also claims that the low price of the tags, only about $29, makes them a "weapon of choice" for harassers. The
lawsuit also states that "the design of the AirTag is defective because the product did not operate - and still does not operate - in a safe manner as a reasonable consumer would expect it to operate when it is used or misused in the manner intended or reasonably expected." The judge ruled this week that the lawsuit can move forward, despite Apple's attempt The lawsuit was filed by about 36 women and men who claim that Apple was warned of the risks inherent in the product and that the company can be held legally liable under California law.

"Ultimately, Apple may be correct that the law does not require it to do more to minimize the ability of harassers to use the AirTag for surveillance, but at this point, that cannot be determined," the judge said.
Apple, for its part, claimed in response that "the lawsuit is a wrongful attempt to hold it legally responsible for a third party's intentional misuse of its product to track the plaintiffs or their family members without consent. Apple strongly condemns any misuse of its products and willingly assists law enforcement authorities in investigations of complaints about unwanted surveillance".
