(ANSA) - ROME, NOV 11 - The extension of the block on evictions for arrears - ordered by the legislator in the presence of an exceptional situation such as the Covid-19 pandemic - is an intrinsically temporary measure as it is destined to run out by 31 December 2021, "without the possibility of further extension, since the compression of the property right has reached the maximum tolerability limit, even considering its social function (article 42, second paragraph, of the Constitution) and the obligations of solidarity between associates (article 2)". This was established by the Constitutional Court, as stated in the grounds for a judgment. The sentence is n. 213 filed today (editor Giovanni Amoroso) with which the Constitutional Court recognized the legitimacy of the extensions (from 1 January to 30 June 2021 and then from1 July to 31 December 2021) of the suspension of the execution of certain property release orders.
