Damascus-SANA

With the aim of granting university cities administrations sufficient financial and administrative powers that enable them to provide clean, safe and comfortable housing efficiently and effectively for students and help them complete the required work of services, maintenance and rehabilitation, in addition to building new units, managing facilities and facilities attached to the cities and investing some of them.

Today, President Bashar al-Assad issued Law No. (29) of 2022, which provides for the transformation of university dormitories into public bodies of an administrative nature that are financially and administratively independent.

Below is the full text of the law.

Law No. (29)

President of the Republic

According to the provisions of the Constitution...

And what was approved by the People’s Assembly in its session held on 7-11-1443 AH corresponding to 7-6-2022 AD;

The following is issued...

Article 1 - The following words and phrases, in the context of the application of this law, have the meaning indicated next to each of them:

Minister: The Minister of Higher Education and Scientific Research.

The University: It is the university subject to the provisions of the Universities Organizing Law No. (6) of 2006 and its amendments.

University President: The president of the relevant university.

University City: A university city established under the provisions of this law.

Board of Directors: The University City Board of Directors.

General Director: The General Director of the University City.

Union: The National Union of Syrian Students.

Article 2 -

A- A public body of an administrative nature shall be established in the name of the university city, enjoying legal personality and financial and administrative independence in each governorate in which a university is established, one of the universities subject to the provisions of the Universities Organizing Law No. (6) of 2006 and its amendments and linked to the university president.

B - The provisions of Paragraph (A) of this Article shall not apply if the number of housing units is less than three units.

C- The newly established university city under the provisions of this law replaces the existing university city in the university, with all its rights and obligations, and the ownership of all lands, buildings, establishments, kiosks, clubs, restaurants, canteens, theaters, furniture, equipment, machinery and tools that exist or are contracted for in their favor on the effective date of the contract this is the law.

Article 3 –

The university city aims to provide adequate and safe housing efficiently and effectively for university students residing there, in accordance with the foundations and standards set by the Board of Directors.

Article 4 –

The university city administration:

- Management Board.

- Director general.

Article 5 –

a- The board of directors consists of:

President of the University as President

Vice President for Student Affairs, Member

- General Manager as a member

- Deputy Director General, member

A representative of the Federation nominated annually by the Executive Office of the Federation as a member

b- The assistant director general shall assume the secretariat of the council.

Article 6 –

A- The Board of Directors meets at least once a month, and whenever there is a need for that at the invitation of the Chairman of the Board. The meetings are legal in the presence of the majority of the members, including the Chairman. Decisions are taken by voting unanimously or by the majority of the votes of the members present. In the event of equal votes, the side of the Chairman of the Board shall prevail.

B- The Chairman of the Board of Directors may invite whomever he deems appropriate to attend its meetings, without the invitee having the right to vote.

C- The Board of Directors may form committees from among its members and others to study a specific topic and submit the necessary suggestions for that.

D- The members of the Board of Directors shall receive compensation for attending each session of the Board, which is determined in accordance with the laws and regulations in force.

Article 7 –

The board of directors is the authority concerned with drawing up the general policy of the university city and developing plans that achieve its objectives.

A- Approving the regulations related to the university city, the provisions related to student admission, the conditions of residence and the discipline system therein. These regulations are issued by a decision from the university president.

B- Proposing a service allowance for housing and accommodation in the university dormitory in line with the educational policy of the state, and it is issued by a decision of the Minister.

C- Approving the annual budget for the university city, distributing the funds allocated to it on various items, and submitting it to the Ministry of Higher Education and Scientific Research.

D- Approval of filing lawsuits in the name of the university dormitory, waiving them, releasing them, and arbitration in accordance with the laws and regulations in force, without prejudice to the rules stipulated in the State Case Management Law.

e- Accept gifts, bequests, donations and subsidies in accordance with the provisions of the laws and regulations in force.

F- Approval of the annual plan for training and qualification of university staff.

g- Acceptance of housing for students of universities and higher and technical institutes affiliated with the Ministry of Higher Education and Scientific Research.

H- Setting the rules of comparison among students for residency in the university dormitory.

I - Approval of the construction of housing units or facilities attached to the university city in accordance with the laws and regulations in force.

J- Proposing the functional structure and numerical staffing of the university city.

Article 8 -

a- The general manager of the university city is named by a decision of the Prime Minister based on a proposal by the Minister.

B- The director general of the university city shall retain his original position and legal promotions if he is appointed from among the members of the teaching staff at the university.

Article 9-

The Director General shall have an assistant appointed by a decision of the Minister based on the proposal of the University President.

Article 10 –

The Director General exercises supervision over all the work of the university city in terms of administrative, financial, technical, service, investment and student aspects. He is the official reference for all its employees, issues instructions and administrative orders, follows up on the implementation of the decisions of the Board of Directors, and directly supervises the progress of work in it, and in particular performs the following tasks:

A- Represents the university city before the courts and others.

b- He signs the current transactions and correspondence, and he may delegate some of his powers to his assistant and sign some of the correspondence and transactions.

C- He shall complicate the expenditures and prepare an order for liquidation and disbursement in accordance with the provisions of the laws and financial regulations in force for public bodies of an administrative nature.

D- He proposes the university city budget draft and presents it to the board of directors.

e- Submit an annual report on the implementation of the plans to the Board of Directors, including the financial, administrative and technical status of the university city.

F- It is suggested that transfers be made between the university city budget items after the approval of the Ministry of Finance for the current operations.

g- In emergency cases, he who deems it necessary to be in the university dormitory shall summon from among its employees during or outside official working hours.

H- Issues all the instructions that regulate the financial, administrative, technical, service and investment affairs in the university dormitory.

i- Determines the daily work cycles and work schedules for the workers in the university dormitory.

Article 11-

A- The resources mentioned below that are collected by the university city as self-resources are placed in a separate account in one of the public banks according to their receipt in Syrian pounds or foreign currency:

1- 50% (fifty percent) of the service allowance collected annually for residence and housing in the university dormitory, and the remaining amount of the service allowance belongs to the state’s public treasury.

2- Investment allowances for restaurants, canteens, forums, kiosks, buildings, lands, stadiums and facilities in the university city.

3- Grants, subsidies, gifts and bequests accepted by the Board of Directors in accordance with the laws and regulations in force.

4- The annual subsidy allocated by the Higher Education Council based on the proposal of the competent university council from the university’s own resources.

5- Any other resources permitted by applicable laws and regulations.

B- Disbursement from the self-resources mentioned in Paragraph (A) of this Article shall take place for the following purposes:

1- Contributing to building and equipping new housing units.

2- Restoration and maintenance of existing housing units.

3- Restoration and maintenance of public facilities and improvement of public services.

4- Building facilities attached to the university city.

5- Other objectives to be determined by a decision of the Minister after the approval of the Minister of Finance.

C- The percentage of exchange for the purposes specified in Paragraph (B) of this Article shall be determined by a decision of the Minister after the approval of the Ministry of Finance based on a proposal by the Board of Directors.

Article 12-

A proportion of 15% fifteen percent annually of the operating or management allowances for restaurants, forums, kiosks, canteens and stadiums in the university dormitory is allocated for the benefit of the Union, and 10% ten percent annually of the same allowances for the benefit of the teachers’ union branch at the university and the health and social solidarity fund at the university. Percentages by decision of the Minister.

Article 13-

Each university city shall have an independent budget with a special branch in the state's general budget.

Article 14-

The provisions of Article 147 of the Universities Organizing Law No. (6) of 2006 and its amendments apply to the university dormitory.

Article 15-

A- University employees who are assigned to work in the university dormitory are considered transferred by virtue of the university dormitory owners on the date this law comes into force, and their vacancy is legally up to date with the same wages, jobs and categories, while retaining their acquired footprint for the next promotion.

B - Delegates or contractors to work in the university dormitory shall continue their work until the expiry of their assignment period or the expiry of the term of their contracts unless they are extended or renewed in accordance with the laws and regulations in force.

Article 16-

The job structure, including the numerical staffing of the university city, is issued by decree.

Article 17-

Taking into account the provisions contained in this law, the laws and regulations in force in the public bodies of an administrative nature shall be applied to the university city. The employees of the university city are subject, in everything that is not stipulated in this law, to the provisions of the Basic Law for state employees.

Article 18 -

This law to be published in the official newspaper.
