Coronavirus: curfew lifted in Martinique by court decision

The curfew was lifted Friday in Martinique after an interim order from the president of the administrative court of Fort de France, which suspended a prefectoral decree extending the curfew until June 2, 2020, we learned from prefect and judicial source.

Established since March 30 from 8 p.m. to 5 a.m. by the prefect of Martinique, Stanislas Cazelle, the curfew had been modified last Monday. The prefecture then established it between 9 p.m. and 4 a.m. until June 2.

Seized urgently, the administrative court of Martinique, ruling in chambers of summary proceedings, considered that the curfew measure was "not justified by the sanitary situation of Martinique on the day of its decision, which is characterized by 189 confirmed cases of Covid-19 damage, a reduction in two of the number of patients hospitalized in intensive care, and a number of seven positive cases noted on the whole of Martinique during the last seven days ” .

The prefect "takes note"

In a short press release on Friday, the prefect said that he had taken note of this judgment and decided to revoke this order. The curfew is therefore lifted as of today in Martinique ” .

The court had been seized by four applicants, including restaurateurs who notably used delivery. According to their lawyer, Me Jiovanny William, they have adapted to the sanitary measures but "their activity is interrupted at 9 pm" . A real shortfall for these companies already weakened by containment.

"During the confinement it was necessary, " confides Me William to AFP, "but we came out of the confinement, Martinique is in the green zone and other territories have repealed the principle of the curfew" . All the more, he adds, that “Martinique is a good student in the application of barrier gestures. We have to be able to work! ” .

Among the applicants, there was also a citizen who denounced the ban on the simple freedom to come and go. For Me William, “this decree was taken without consultation. It is an infantilizing decree. We are old enough to respect the rules ” .
