Contest a report on return from vacation

USER'S RIGHTS - Is it the unpleasant surprise of returning leave: administrative letters from the French administration or even from abroad informing you of offenses committed during the summer? How to react and assert your rights?

1 - PV of automatic radars, video over-marking or on the fly ...

In all these cases of verbalization, in the absence of a questioning of the driver, it is good to remember that the recipient of the report has no obligation to report himself or to report the driver at the time of the offense.

You are therefore perfectly entitled to dispute that you are the perpetrator of the offense. You will then only be liable for the fine without suffering any other sanction such as license suspension or loss of points.

Do not forget, however, that payment of the fine constitutes recognition of the offense and results in the loss of points linked to the offense.

You have 45 days to dispute your violation.

2- PV abroad

Once back in France, no administration of a foreign state can force you to pay a fine committed on its territory.

The administration of the country concerned must necessarily require the intervention of the French authorities.

However, these are not required to execute a financial conviction decision from abroad if the financial penalty is less than 70 euros or if the fact does not constitute an offense under French law.

To be forced to pay, it is therefore necessary that the French courts impose it on you at the request of the foreign authorities.

Also note, that a car rental company cannot under any circumstances use your bank details to pay the fine for you, but it may, according to the contract, charge you management fees.

3- improper parking report

Some motorists find themselves having to manage on their return parking tickets that have accumulated on their vehicle left improperly parked near their home.

Remember that it is indeed forbidden to improperly leave a vehicle parked on the public highway for a period exceeding seven days (or for a shorter period according to the mayor's decree).

However, in such a situation, a single report for improper, dangerous or inconvenient parking can be drawn up, even if the vehicle has not moved for several weeks.
