Eric Trump has to take oath to answer questions about business practices at his family's real estate company before the November presidential election.
That was decided by a court in New York on Wednesday.
The court is not subject to the election schedule - and Trump must comply with his subpoena by October 7, according to Judge Arthur Engeron.
Trump's lawyers had argued that President Donald Trump's son's "extreme travel scheduling" campaign would justify postponing the summons until after the election.
They also wanted to avoid Trump's subpoena being misused for political purposes.
The New York prosecutor's office has been investigating since March 2019 whether the Trump organization has stated assets either too low or too high in order to pay less for loans and insurance and to save on property taxes.
This was what Donald Trump's former personal lawyer Michael Cohen had testified to before the US Congress.
Donald Trump handed over the management of the Trump Organization to his sons Eric and Donald Jr. after his election as President in 2017, but he remains the owner of the family holding company.
Other proceedings are ongoing
New York attorney general Letitia James went to court to enforce Trump's subpoena and release of documents after his attorneys abruptly canceled an interview in July.
"Today's order from the court makes it clear that no one is above the law, not even an organization or a person named Trump," James said, according to media reports.
It is not the only investigation against the Trump company.
The Manhattan attorney, Cyrus Vance, wants to obtain the release of tax documents from Trump and his companies over a period of eight years.
The investigation also concerns alleged hush money payments from Trump to two women, both of whom claim to have had affairs with Trump.
The US President denies this.
