The 23rd Meeting of the Standing Committee of the 13th National People's Congress deliberated the "Proposal of the State Council on Requesting a Decision on the Qualifications of the Legislative Council Members of the Hong Kong Special Administrative Region."
The above-mentioned motion was proposed at the request of the Chief Executive of the Hong Kong Special Administrative Region.
The meeting held that in order to fully and accurately implement the "One Country, Two Systems" policy and the Basic Law of the Hong Kong Special Administrative Region of the People’s Republic of China, safeguard national sovereignty, security and development interests, and maintain Hong Kong’s long-term prosperity and stability, it is necessary to ensure that relevant public officials in the Hong Kong Special Administrative Region include members of the Legislative Council. Comply with the legal requirements and conditions for upholding the Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China and loyal to the Hong Kong Special Administrative Region of the People's Republic of China.
To this end, the Standing Committee of the National People’s Congress agreed to the resolution proposed by the State Council on November 7, 2020, in accordance with the provisions of Article 52, Article 54 and Article 67 Paragraph 1 of the Constitution of the People’s Republic of China. 1. Members of the Legislative Council of the Hong Kong Special Administrative Region promote or support the "Hong Kong Independence" claim, refuse to recognize the state's ownership and exercise of sovereignty over Hong Kong, seek foreign or foreign forces to interfere in the affairs of the Hong Kong Special Administrative Region, or otherwise endanger the country Acts such as security do not meet the statutory requirements and conditions for upholding the Basic Law of the Hong Kong Special Administrative Region of the People’s Republic of China and allegiance to the Hong Kong Special Administrative Region of the People’s Republic of China. 2. This decision applies to members of the sixth legislative council who were ruled invalid by the Hong Kong Special Administrative Region in accordance with the law during the nomination period for the election of the seventh legislative council of the Hong Kong Special Administrative Region originally scheduled to be held on September 6, 2020.
This decision shall apply to all those who participate in elections or serve as members of the Legislative Council in the above circumstances.
3. Anyone who loses his qualifications as a member of the Legislative Council in accordance with the above provisions shall be declared by the Hong Kong Special Administrative Region Government.
