Plagiarized thesis: Arash Derambarsh remains a lawyer

2020-11-20T08:41:12.234Z

The council of the order points to "the blameworthy lightness" of the university in the case of the thesis of Arash Derambarsh. And refuse at this point to

Stuck in his plagiarized thesis case, Arash Derambarsh can rejoice with a first victory.

In a decision rendered on November 10, the council of the Paris Bar Association did not pronounce its suspension.

Arash Derambarsh, the stirring elected of Courbevoie, also known for his involvement in the fight against food waste, therefore remains Master Derambarsh.

For the time being.

The council of the order looked into his case after a report from the university on September 2.

The new administrator of Paris I Panthéon-Sorbonne informed the council of the order of the cancellation of Arash Derambarsh's doctoral thesis, decided in July.

"A collection of texts published by others"

For the disciplinary body of the university in fact, the thesis which, in 2015, gave Arash Derambarsh the title of doctor of law is three quarters the result of plagiarism: "an assembly of texts published by other authors than himself and recopied according to one or more of the plagiarism aimed at making the reader believe that Mr. Derambarsh is the author ”, we read in the disciplinary decision.

This thesis, devoted to police files, had allowed Arash Derambarsh to enter the law school.

He was then sworn in almost three years ago.

It was therefore, for the council of the order, to question its possible "breaches of the rules of the legal profession, in particular the principles of conscience, probity, honor, loyalty, delicacy and courtesy".

Concretely, for having concealed that his certificate of aptitude for the profession of lawyer was based on a thesis tainted with fraud, for having practiced on the basis of a doctorate in law obtained fraudulently, and for having produced versions falsified his thesis when the university investigated plagiarism in 2019, when he was already a lawyer.

He disputes any plagiarism

Assisted by two of his lawyers - there are six in all - Arash Derambarsh explained himself to his peers at the end of October.

The disciplinary section underlines the "seriousness of the grievances", notes the explanations which are often "confused" or "imprecise" by the person concerned.

But concludes that "the accusations are not sufficiently substantiated", in particular because the result of the investigations carried out on the various versions of the thesis were not paid to the debates before the council of the order.

Above all, the disciplinary section considers that the university "has shown a blameworthy lightness in the follow-up of the students, the composition of the juries and the management of the theses in general, of that of the party prosecuted

(Editor's note: Arash Derambarsh)

in particular.

"

An open judicial inquiry

What inspires this comment to his lawyer, Me Yassine Bouzrou: “This decision appears to me to be founded.

What the council of the order underlined, the blameworthy lightness attributable to the university, the dysfunctions in the management of theses, we denounce it from the beginning.

"And to recall that" Mr. Derambarsh firmly denies any plagiarism and will continue to face these accusations with serenity ".

Indeed, the case is far from over.

Arash Derambarsh having appealed against the decision of the university canceling his thesis, the case will be re-examined.

In addition, a judicial inquiry is opened.

Also on the basis of a report from La Sorbonne, the Paris prosecutor's office opened this investigation at the end of October and entrusted the investigations to the People's Crime Repression Brigade (BRDP).

If at this stage, the council of the order has not decided on a provisional suspension, nothing prevents it from re-examining the case of Arash Derambarsh as the case develops.
