The Jerusalem District Court today (Sunday) sentenced Ita Rabinovich, a caregiver convicted of causing damage to a six-month-old baby, to six months of community service.

This is after a plea deal, in which the punishment demanded by the prosecution was given.

She was also sentenced to probation and compensation in the amount of five thousand shekels.

The prosecution sought the light sentence following a change in the indictment, after the expert in the case withdrew her medical opinion.

Judge Yaakov Tzaban accepted the position of the State Attorney's Office as part of the plea agreement and ruled that "from an evidentiary and factual point of view, the agreement correctly reflects the situation. "And therefore the order of argument obtained after real deliberations must be respected, but reflect the difficulties we often experience in situations of uncertainty."

According to the indictment, the baby, who was less than 6 months old, was brought to the defendant who cared for him in her apartment, and towards noon he was rushed to the hospital with an injury to his body.

Today he suffers from a very severe disability, which includes vision problems, severe developmental problems and he has been recognized as having autism.

Rebecca, the baby's mother, said: "It's really not a punishment. There are flaws throughout the trial, and we want to appeal and have justice for our child. This punishment will not deter other caregivers either. "In my sentence, they took my life and ours in a certain way, and there is nothing to comfort our hearts. We have the strength and we will continue to fight for everyone's children and we will fight to the end."

In cases of 'shaking' a baby, it is very difficult to identify and decipher the mechanism of injury and isolate the damages caused as a result.

The prosecution made many efforts to reach an investigation into the truth, instructed the police to exhaust the investigation and also sought the opinion of another expert who examined the possibility of attributing the entire damage to the caregiver herself.

For reasons of individual confidentiality and medical confidentiality we will not be able to elaborate beyond that and explain the full considerations that led to the plea agreement.

However, the matter was explained to the family, who were accompanied by the State Attorney's Office throughout, and their position regarding the arrangement was also taken into account.
