Miesbacher district committee recommends the establishment of two municipal companies

More room for maneuver for hospitals than municipal companies

As reported, the main reason for the reform is to make the hospital fit for future investments.

Because the two municipal enterprises (KU) are no longer included in the district budget, they can take out loans more easily and gain more room for maneuver.

The money is to flow into a geriatric rehabilitation clinic, a parking deck and apartments.

The WPE is to receive an additional 1.75 million euros for the construction of a combined heat and power plant.

District committee passes resolutions unanimously

The resolutions now unanimously passed in the district committee included, among other things, the transfer of the special assets of the company's own operations to the two KUs and Schwaighof GmbH, the corporate transformations described and the necessary changes to the articles of association and shareholder agreements.

Representatives from the hospital and Schwaighof as well as the lawyers and notaries commissioned were connected via video.

No one in the committee questioned corporate reform as such.

"We do this to secure the future of our company," emphasized Vice District Administrator Jens Zangenfeind (FWG).

Above all, the preservation of the municipal hospital has the highest priority.

"Unfortunately, the state has no interest in small clinics," said Zangenfeind.

District Administrator Olaf von Löwis (CSU) rated the unanimous resolutions as a “great signal”.

Discussion of the clause on granting loans to third parties

According to district treasurer Gerhard de Biasio, there were no major discussions.

Only Birgit Eibl (FW) sat in front of the camera in the middle of the plenary to raise a point of criticism.

The lawyer was bothered by the passage that the board of directors could approve loans and salary advances not only to board members and employees of the KU, but also to third parties such as their relatives.

"Politically, I cannot agree that taxpayers' money is dealt with in this way," Eibl made clear.

Attorney Stefan Detig explained that this clause is actually intended as a safeguard.

Its purpose is that the board of directors cannot make this decision alone, but only with the consent of the board of directors.

"I wouldn't want to take such things on my own head", confirmed hospital manager Michael Kelbel.

On top of that, things like that are rare anyway and are only used to prevent damage to the company.

Weyarn's Mayor Leonhard Wöhr (CSU) reminded that an employer in the public service also has a duty of care for employees in need.

She has no problem with that, said Eibl.

You only ask to exclude loans or advances to third parties.

"I was not chosen to have confidence, but to express my concerns," emphasized the FW district councilor.

Ultimately, the district committee then agreed on the advice of district auditor and investment manager Claudia Winterberg to change the statutes accordingly.

Schwaighof: The GmbH has proven itself for 20 years

Eibl's request, however, managed to convert the Schwaighof into a municipal company only as a quote in the minutes of the meeting.

The GmbH has proven itself here for more than 20 years, emphasized Managing Director Jürgen Pohl.

In addition, private sponsors would find grants more easily than municipal ones.

Pohl assured us that we would continue to operate solidly and aim for the black zero.

"The type of company is irrelevant for the quality anyway." The district administrator was happy to confirm this: "The Schwaighof has come through the pandemic very well so far."
