The Knesset has finally approved the law that abolishes the authority to limit the license - even for alimony debtors who are in divorce proceedings. • Adv. Bornstein, an expert in enforcement law:

Shake-up in the field of enforcement: The Knesset yesterday (Tuesday) finally approved the law that abolishes the authority to restrict the driving license of debtors in execution, including debtors in alimony who are in divorce proceedings.

Until now, the renewal of a driver's license could be restricted to those against whom an execution case was opened or who owed alimony in a divorce, due to a debt of more than NIS 2,500 within six months from the date of the warning, and due to a debt of more than NIS 500 within one year of the warning. To debtors.

Due to the severe significance of the restriction, the Execution Registrars would not have approved it immediately to date - but only after it has been proven that the winner of the Execution Case has taken, prior to the restrictions, alternative collection proceedings.

A post by Justice Minister Gideon Saar states that "nowadays freedom of movement, and sometimes also the ability to earn a decent living, is related to a driver's license. This restriction has no connection to debt collection and assets that can be used to repay the debt. "Now it has also been abolished in Israel."

In fact, the Knesset decision has an impact on tens of thousands of citizens in Israel.

"This is certainly significant news in enforcement cases," said attorney Shelly Bornstein, an expert in enforcement and insolvency law.

It seems appropriate to repeal the restriction on the renewal of a driver's license, subject to the determination of another collection tool in execution, prior to the repeal of this restriction.

"On the other hand, it was indeed a collection tool that hurt debtors to a great extent, especially after the abolition of a limited debtor procedure by means (consolidation of cases) and more. Hence, another solution should have been found that helps debtors on the one hand, and helps winners - who may become debtors tomorrow.
