Opinion | Netanyahu will not enjoy the "fruits of the poisoned tree" | Israel today

2022-02-10T12:24:08.964Z

Even if it turns out that there were investigators who acted improperly and used tools that they were not allowed to use - there is no real chance that all the accusations will be dismissed.

Will not disappear like a magic wand.

Some of Benjamin Netanyahu's ardent fans have been very disappointed by what has been revealed in recent years regarding his behavior.

This is mainly a gift affair, precisely because it is the most understandable and undeniable, and even if it does not lead to criminal conclusions - it overshadows his public image.

Many others among his supporters, repress.

He told them off stage that "there is nothing," and let them complete, as in public singing, "because there was nothing."

They do not want to believe that the object of their admiration is conducted in this way, and prefer to believe that all the people in the most senior positions in the law enforcement system - which he himself appointed - are actually the ones sent by a conspiratorial system to push him out of power.

They breathed a sigh of relief when he apparently made the mistake of his life, and opposed - just like Moshe Katsav - a plea deal, and they want to believe that the possibility that certain evidence was obtained, apparently, illegally, would lead to the cancellation of his trial as a magic wand.

But Netanyahu's files are laden with evidence, and even if it turns out that there were investigators who acted improperly and used tools that they were not allowed to use - there is no real chance that all the charges will be dropped.

One reason for this is that the cases do not stand on this particular evidence, and the second reason is that in Israel there is a legal separation between the way in which the evidence is obtained and its use.

In the United States, there is indeed a "poisoned tree fruit" rule, according to which illegally obtained evidence is inadmissible. In most democracies around the world, the use of such evidence separates the punishment of the user. If Netanyahu has friends, it is better that he be advised to accept a fair plea deal, and not to build, with his fans, on imaginary options.

Again, apartheid?

Israel has had an ongoing occupation for 55 years and must end, not only because the Palestinians have the right to self-determination like us, but because we are on the verge of an unacceptable situation of a Jewish minority dominating a Palestinian majority.

Anyone who has been tormented by reading the 280-page Amnesty International report, which defines the Israeli regime as an apartheid regime, even if it uses definitions from international law that expand its reference to this regime, cannot be convinced that Israel is based on apartheid. International "as an antisemitic organization, can not be a substitute for factual answers.

The report is angry not only because it has inaccuracies, and because it presents a situation in which inequality is created, ostensibly, from a calculated policy of all Israeli governments, but also because the assertion that apartheid is already here. And he is not. There is nothing to do but call on the world to impose sanctions on Israel, knowing that this will not happen.

Anyone who knows Israel can be angry, like me, at the serious phenomena that occur in it, and one of them is the "law of the nation" that violates equality, and its abolition - or, at least, its amendment - is necessary.

But it should be understood that this is not a regime that forbids people of different origins to live together, and that was precisely the hazelnut of the racist regime that existed in South Africa.

All democracy indices classify Israel as democratic, even if in some international indices it is defined as a flawed democracy (democracy, alongside the US. An apartheid state can neither be democratic nor semi-democratic. Amnesty researchers sought to raise a red flag, but set fire, And the fire weakened their arguments, because of the lack of distinction between the situation in sovereign Israel and the situation in the territories, and because of the unilateralism they took.

Were we wrong?

Fixed!
