The reform, which still needs to be passed by the Senate to enter into force, provides many limitations for magistrates, prosecutors and judges wishing to enter politics, a frequent phenomenon in Italy.

For example, a magistrate wishing to stand in national, regional or European Parliament elections as a Member of Parliament cannot do so in the region where he has served in the previous three years.

General reform of Italian justice

A magistrate who is a candidate for the post of mayor of a municipality cannot stand either if he has had judicial authority over this municipality during the previous three years.

For those who are elected, the career of magistrate ends and there is no longer any possibility of going back.

For those who are not elected, on the other hand, there remains a three-year ban on exercising their judicial functions both in the region where they stood for election and in those where they previously exercised.

This reform, which essentially concerns the careers of magistrates, is part of a broader reform of the Italian justice system, sadly famous for its slowness, and which was demanded by the Commission in Brussels so that Rome could benefit from the funds of the European recovery, of which Italy is the main beneficiary with 191.5 billion euros.

According to an assessment of the rule of law in Italy carried out by the European Union in 2021, the level of perception of the independence of the judiciary in the country is low.

Only 34% of public opinion considers it "

fairly or very good

", against 54% as "

fairly or very bad
