Trump tries to avoid justice in New York by creating a new company in Delaware

On September 21, the day the lawsuit was filed, the new firm registered in Delaware -a practical tax haven, which allows companies to have their headquarters in any state in the country and also benefit from corporate tax exemptions- submitted documentation in New York to be recognized as such.

Delaware is also the home state of President Joe Biden.

Although Trump's lawyers have explicitly said that they are not preparing to avoid the possible consequences of James's lawsuit, plus they offer "guarantees and advance notice" to investigators, the New York attorney general has urged a court Thursday to appoint an independent expert to monitor the Trump emporium -that is, to ensure that it does not sell or divert assets and to supervise the possible presentation of financial information to third parties- before the start of the fraud trial against the former president, three of his children (Donald Jr, Eric and Ivanka) and the family real estate company.

James has also asked the state court in Manhattan to bar the Trump Organization from disposing of assets while the process unfolds.

The prosecutor intends to accelerate the development of the case, with an eye on a possible trial in October 2023.

his Delaware emporium, James' writ released today indicates, Trump is attempting to restructure his businesses to avoid potential fallout from the lawsuit, which accuses the Trumps of inflating the value of their assets and net worth for a decade. of financial makeup before banks and insurance companies, in order to obtain credits in advantageous conditions and also tax benefits.

According to James, the Trump Organization - the parent company, based in the homonymous tower on Fifth Avenue in Manhattan - has given no guarantees that it will not try to move assets out of New York.

"Since we filed the lawsuit last month, Donald Trump and the Trump Organization have continued those same fraudulent practices and taken steps to evade responsibility," James, who is running for re-election in November, said in the statement issued by the prosecutor's office he heads.

“Today we are trying to stop these actions immediately.”

In August, Trump refused to testify before James so as not to incriminate himself.

On the part of the Republican, who shakes the board of the disputed mid-term elections with a legion of candidates for his figure, James's new movement confirms the "political persecution" of the Democrat, as well as the attempt to take personal advantage in november.

“We have repeatedly assured, in writing, that the Trump Organization has no intention of doing anything improper,” said lawyer Alina Habba in a statement collected by the Reuters agency.

The lawyer described James' request for an independent expert as a "ploy" to promote her re-election campaign and an attempt to influence the appointment of the judge assigned to the case.

The Trump Organization manages hotels, golf courses and other real estate around the world, and has been investigated by James for more than three years, in parallel to another criminal case opened by the Manhattan prosecutor's office.
