The suggestive points in common in the cases of illegal spying on judges and politicians

They were all spied on with the same system and the judges were just on dates when they had to define judicial files. The suspicion of a large illegal network, and the situation of D'Alessandro and Santilli.


There are at least three cases that began with complaints of hacking and wiretapping filed separately, but that

are beginning to have connection points.

These coincidences are observed by federal justice as

possible pieces of a larger puzzle

.

They do not rule out being before

a larger illegal espionage network

, whose objectives are judges and former officials.

In Comodoro Py, federal judge

Marcelo Martínez De Giorgi

is in charge of three files whose collected evidence begins to unite them.

The same

modus operandi

 exposed some data that could lead to a unification of the cases under the same procedural object.

At the moment, all the files are processed separately but they were grouped under the same body that analyzes all the evidence: the Directorate of Judicial Assistance in Complex Crimes and Organized Crime of the Supreme Court of Justice of the Nation (DAJuDeCO).

With his intervention, the judge seeks to establish the identity of the person responsible for the hacking of the cell phones of judges

Mariano Borinsky

(member of the Federal Court of Criminal Cassation),

Rodrigo Giménez Uriburu

(Federal Oral Court 2) and 

Horacio Rosatti

( President of the Court).

All of them filed the corresponding complaint when they observed the irregularities in their respective cell phones.

The president of the Supreme Court found himself in another situation: without his knowledge, someone had taken out at least four cell phone lines in his name.

"It cannot be ignored that all the victims are 

federal judges with intervention in sensitive cases

," a judicial source told Clarín.

It must be remembered that magistrates

Andrés Basso

(also of the Federal Oral Court 2) and

Gustavo Hornos

(of the Federal Cassation, like Borinsky)

, were also victims of a hack.

These last two judges did not make criminal complaints but rather administrative ones before the cell phone provider companies.

However, as

Clarín

found out , it is not ruled out that they end up making a presentation in court.

The suggestive coincidences between all the files are the following:


1- The work of the victims

All those hacked or whose identity was violated to process telephones -Rosatti- are federal judges and a court minister who

must hear cases of corruption that are sensitive to Kirchnerism,

 among which they coincided, in various instances, in the Highway case, where Cristina Kirchner ended up sentenced to six years in prison for acts of corruption.

Not only that file, but other sensitive cases for the vice president.

Regarding the members of Chamber IV of the Chamber of Cassation, they were responsible for confirming at the beginning of the year the sentence against Lázaro Báez for money laundering, setting the sentence at ten years.

The president of the Court is one of the most criticized by Kirchnerism, not only was he in front of the Council of the Magistracy but also signed a series of resolutions with his peers endorsing the trial for the direction of public road works when the Vice was looking to overturn it.


2- The place of hacking

Another of the elements that the court took into account was the place from which the maneuvers denounced by the three judges were carried out.

The first reports, judicial sources pointed out to

everything took place from Misiones.

This information could begin to be linked to the investigation that is being processed in the Buenos Aires justice system, where judge

Araceli Martínez

and prosecutor

Daniela Dupuy

 are investigating an alleged illegal espionage organization.

In this case, the young 

Ezequiel Nuñes Pinheiro

confessed  and said that

he was hired to hack the cell phone of fifteen people.

That list includes the names of judges

Borinsky, Hornos, Basso and Giménez Uriburu.

Sources of the case do not rule out that there is some connection with the situation denounced by the president of the Court.

The hacking of that list that he called "targets" was carried out through the technique called "SIM SWAP" or creation of twin SIM cards for cell phones.

This is another of the coincidences observed in Comodoro Py:

the same technique used in all cases

.

This includes the former Minister of Security of the City,

Marcelo D'Alessandro, 

and the deputy

Diego Santilli

, both referents of Together for Change.


3- A key month

The researchers also put the magnifying glass on the dates of the hacks.

In September 2022, when the defense of Cristina Kirchner began her argument in the Highway trial and with a few days of difference, three of the judges lost control of their cell phones.

On September 8, judges Mariano Borinsky and Rodrigo Giménez Uriburu detected the anomalies in their cell phones.

Andrés Basso was hacked on the 30th of the same month.

On September 23, Cristina Kirchner spoke for the last time in the trial to defend herself against her.


4- Theft of Affidavits

Finally, there is another piece of information that brings together all the judges of Comodoro Py who were part of Ezequiel Nuñez Pinheiro's list of fifteen "targets": all of them had had

their reserved affidavits stolen in July 2022

, when it was learned that intruders had entered the court. Council of the Magistracy during a long weekend.

This documentation accompanies the public affidavits of the magistrates, but as it contains sensitive information - bank and tax data, among others - it maintains the reserved nature.

All these elements are beginning to be analyzed in the Buenos Aires federal courts as parts of a great puzzle, and they do not rule out that it is facing an "illegal espionage network that is even larger, where it is necessary to determine who is the person responsible behind it." indicated a legal source.
