The Federal Justice ruled in favor of Customs, which claimed to preventively suspend exporters who do not liquidate foreign currency.
In total,
it reaches 25 firms and exceeds US$ 1,500 million.
The judicial resolution was produced from a
request for protection
against the Customs of the oil company El Cerco SRL of Rosario, and gives the green light to the state body.
Although the deadlines to liquidate the currencies range from 15 days from the shipping permit (soy) to 180 days (regional economies), there are cases of 365 days, but always with a maximum of 60 days for operations between related companies.
"To take advantage of the gap,
many exporters do not settle the currencies before the BCRA
and leave it abroad or convert it at the cash exchange rate with settlement," Customs said in a statement.
In this context, Customs issued IG 07/2022 (DGA) establishing guidelines to be followed in those cases in which Exporters do not make the timely entry of foreign currency, establishing that, if effective non-compliance is verified, the agent in charge of the registry will inform the exporter so that, within a period of 10 days, he proceeds to liquidate the corresponding currencies or guarantee their entry (bond insurance) or, if these requirements are not met, the suspension as Exporter from the Customs Registry.
