Today (Monday) the state submitted to the High Court its position regarding the eviction of Khan Al-Ahmar, according to which the demolition orders issued on the compound must be implemented - but the government will determine the timing of the implementation. It is entirely devoted to the responsibility and discretion of the political echelon and is influenced by broad and varied political and security considerations, which the political echelon is required to address in great detail

The state's position was sent to the High Court despite the demand of Finance Minister Bezalel Smotrich and National Security Minister Itamar Ben Gvir not to do so. "To my great surprise, I discovered that the content of the state's answer is not consistent with my policy and the government's policy, as I understand it," he wrote Yesterday Smotrich in a letter sent to the Cabinet Secretary.



According to Smotrich, the state's answer to the High Court was not approved by him, contrary to the coalition agreement signed with him as a minister in the Ministry of Defense. Therefore, he demanded a "discussion in the hall" in his presence, in order to "consolidate the government's policy and the position that will be presented." Ben Gvir echoed Smotrich's words And he added, "I sent a clear message to Prime Minister Binyamin Netanyahu, if the publications about the draft answer are true, this is a shameful and serious decision."

Khan al-Ahmar is a complex that was built illegally in the Mishor Adumim area near Maale Adumim outside of Jerusalem.

The residents of the complex, members of the Jahalin tribe who lived in the Negev until the early 1950s and were expelled from there, live in tents and shacks that were erected without permits.

Today, about 200 members of the Jahalin tribe live in the compound.



For years there were discussions in the High Court regarding the evacuation of the complex - in September 2018 the High Court rejected the petitions filed against the evacuation, and approved the relocation of its residents to an alternative area, located on land near the landfill in the neighboring town of Ezaria.

However, the European Union expressed strong opposition to the demolition of the village, and the European Parliament even defined it as a "war crime".

Then Supreme Court Judge Noam Solberg ruled that a hearing on the matter would be held at the beginning of May, when a decision would be made.

"The government will not talk about one law for Jews and one law for Arabs," said Ben Gvir at the time.
