Alex Pompa killed his abusive father: judges, documents to the Constitutional Court

The case of Alex Pompa, the 22-year-old who on 30 April 2020 ,

in Collegno (Turin), stabbed his father to death during yet another quarrel between the latter and his mother, will

 arrive at the Constitutional Court .

The judges of the Court of Assizes of Appeal of Turin raised a question of the legitimacy of the provision, introduced by the so-called 'Red Code', which in these cases (aggravated homicide by kinship) forbids declaring the prevalence of some extenuating circumstances and therefore to achieve a lower sentence.


    In the first instance, Alex Pompa was acquitted in self-defense.

On appeal, the pg Alessandro Aghemo had reiterated the request for a 14-year sentence, emphasizing that it was the minimum possible.

From the reading of the ordinance it is clear that the appeal judges do not believe that it was a question of self-defense or even of culpable excess.

"It is clear that Alex will be sentenced.

Now the trial is suspended, but the order clearly states that it is not a case of self-defense and, therefore, the sentence will be guilty. We will appeal to the Supreme Court. But I am very saddened. Alex does not he is a murderer and this is not murder."

This was stated by the lawyer Claudio Strata, defender of Alex Pompa,

the young man tried in Turin for killing his father during yet another family dispute.

The judges of the Court of Assizes of appeal, this afternoon, after a long deliberation, sent the documents to the Constitutional Court, raising a question of the legitimacy of the law.

"Alex is not a murderer. You just need to look into his eyes to understand it. If it wasn't for him I wouldn't be alive, I wouldn't be here. Yes, maybe that's what I failed to make the court understand".

This was said by the mother of Alex Pompa, the young man tried in Turin on charges of killing his father during yet another family dispute, immediately after the decision of the Assizes of Appeal court to send the documents to the Constitutional Court.

From the ordinance it is clear that unlike the judges of first instance, who had acquitted the young man, those of the appeal do not believe that it was a question of self-defense.
