Andrés Herrera accused San Lorenzo of extortion: the response of the leadership and what the contract said

In his lawsuit, Herrera states: "Being advanced the negotiations aimed at finalizing my pass to CARP, a few days before the date of conclusion of the contract, CASLA told me that it was an indispensable condition for the defendant (party) to agree to sign the pass, that I return to CASLA the 15% that corresponds to me in the terms of those regulated by art. 8 of the Collective Bargaining Agreement".


He continues: "I did not agree with such an imposition. CASLA's response was that if he did not agree to return the money, there would be no pass. Faced with this reality, and against my manifest will, I was forced to consent to that return of part of my salary."

That is, the player accepts that he signed to return that money to San Lorenzo, but says he did so under threat and extortion. In this sense, Herrera explains: "It was agreed - forced on my part - that when withdrawing the check from FAA (Argentine Footballers Association) I should immediately deliver the check to CASLA."


The lateral details in the lawsuit filed that on February 10, 2022, when leaving the offices of Agremiados, an employee of the Boedo club appeared to demand the delivery of the check that he had just withdrawn in his name. "The check delivered -forcefully- to the defendant did not meet the requirements to be endorsed, so if it was cashed by the defendant or by a third party, this was done in concrete violation of the law," he concludes.


In the contract signed by Herrera, his representative Gustavo Lescovich, the president of San Lorenzo Horacio Arreceygor and the then secretary Miguel Mastrosimone (today vice president) is reflected in its third part: "The parties expressly and unequivocally state that each and every one of the articles of the present have been voluntarily established by both, and that they have had adequate advice for the purposes of signing this document, being in full knowledge of the implications and consequences derived from it".


Labour justice will now have to resolve. "San Lorenzo will defend its position and has all the evidence to prove that what Herrera denounces is false," they say, convinced, in Boedo.
