The Beer Sheva Labor Court recognized a stroke suffered by a young HR manager during the COVID-19 pandemic, caused by her failure to organize a virtual toast, after some employees did not receive a bottle of wine at home for the ceremony. She was also reprimanded by the company's vice president for not yet opening a "user" for a newly recruited employee.

The appeal was filed with the Tel Aviv Regional Labor Court, after the National Insurance Institute refused to recognize the causal connection between the stroke and the two events at work. The employee was represented by Adv. Elisher Feingrish of Markman, Tomshin & Co.

The appeal shows that the HR manager, who worked for a company in the food industry, initiated a virtual toast for Passover during the pandemic. The idea was that all company employees would receive a bottle of branded wine at home and raise a glass in a Zoom meeting.

On the day of the toast, it turned out that due to errors in the addresses of the employees, many of them did not receive the bottle of wine by the time of the toast, and the manager felt that she had failed in her task and concluded that the management was disappointed in her.

Her feeling was reinforced when two days later she received a message from the company's CFO, who wanted to know why it had not yet been opened from a user to a new employee, who should have started working about 10 days later.

Following his request, the HR manager felt that the CFO was approaching her after her failure at the toast, and that her position at the company was undermined.
