An indictment was filed today (Friday) in the District Court against Mogira Masarwa, 28, from Kafr Qara, for chasing a scooter rider, which ended in a fatal hit-and-run accident and the death of Hassan Masarwa, his 23-year-old relative, also a resident of the village. Massarewa was charged with reckless manslaughter, abandonment and obstruction of justice.

The tragic incident occurred on the night of June 1-2, around midnight. ACCORDING TO THE INDICTMENT, MUGIRA WAS SITTING WITH HIS FRIEND ALAA OUTSIDE HIS KINGS BURGER RESTAURANT ON A MAIN STREET IN THE VILLAGE WHEN HASSAN, RIDING A SCOOTER WITHOUT A HELMET AND WITHOUT A LICENSE, PASSED BY SEVERAL TIMES.

The indictment also states that after an exchange between them, the chase began with Mogira driving the vehicle with Alaa next to him. When Hassan entered the alley, he followed him at high speed and a short distance away.

The prosecution claims that in a sharp curve in the road, the collision occurred. Mogira lost control and hit the scooter with the left front, which was pushed forward and hit a metal utility pole, from where it was pushed on, hit a wooden pole, and stopped. Mogira's vehicle hit the electricity pole and stopped.

According to the facts of the indictment, Mogira and Hassan left the scene on foot. The prosecution also claims that a few minutes later, Mogira called his friend Bashir Abu Atta, the owner of the Iron Ambulance, informed him of the injury, asked him to come to the scene but did not tell him that he was the person who hit the deceased.

An MDA team that was called to the scene and arrived at a top speed of seven minutes after the chase began, was sure that Hassan was a pedestrian. He was taken unconscious and anesthetized on a ventilator to Hillel Yaffe Hospital and from there, due to a head injury, he was transferred to Rambam Hospital in Haifa, where he was pronounced dead four days later. His family donated his organs for transplantation.

According to the prosecution, before Mogira turned himself in to the police, he asked Alaa to join him, because before the incident the two saw a vehicle with masked men armed with a gun who tried to shoot him, so they fled.

The Menashe District examiners opened an investigation and suspected that this was a different kind of criminal incident. The case was transferred for further handling by the Crime Fighting Unit in the Menashe area, which cracked the incident.

The investigation seized security camera footage that documented the chase in the narrow alley, contrary to Mogira's version. Alaa, in his interrogation with the police, also testified that it was a high-speed chase and that Mogira hit the deceased. He said that Mogira's version of the masked men was false and that he had been asked to give it. Investigators seized a recording of the conversation in which Mogira admits to Bashir that he hit the scooter.

"The investigation of this murder case is the third of three cases that have taken place in the Menashe area since the beginning of the year, meaning that this is a 100% success rate for the Menashe area," noted Menashe District Commander Shlomi Ben-Shoshan. "We will continue to investigate all the cases and invest many resources and means in order to expose the truth and bring the suspects to justice, all while dealing with demonstrations and public order events that take place every week in the area."

At the same time as the indictment was filed, Judge Inas Salameh ordered the extension of Mogira Masarwa's detention pending another decision. He also rejected defense attorney Michal Koren's request for a publication ban. "The judgment of this case is publicity, as prescribed by law," Justice Salameh ruled.

"My client cooperated fully with the investigating unit and said it was an unfortunate accident," said attorney Michal Koren, who represents Mogira Massarewa. "He was suspected of the offence of murder when, at the end of the day, an indictment was filed for the offense of reckless manslaughter. In the coming days, I will be required to review the investigation material and I will be able to take seriously beyond what was provided," she added.

Following the investigation of the case in which Masarwa lost his life in a vehicular attack, the Abraham Initiatives organization reported that 104 Arabs lost their lives in 2023 in circumstances related to violence and crime. By comparison, in the same period last year, there were 44 victims.
