Former President Donald Trump is likely to face another indictment, according to a leak to NBC.

According to a tweet from the network, based on two sources, Trump's lawyers have been instructed to prepare for an indictment by the special federal prosecutor investigating the breach of Capitol Hill and the attempt to overturn the results of the 2020 election.

The leak comes just hours after it became known that his lawyers had met with Special Counsel Jack Smith and weeks after Smith sent them a letter stating that Trump was the subject of an investigation

An indictment in this matter will likely revolve around what Trump told his supporters at a demonstration shortly before they gathered around the U.S. legislature for a demonstration that spiraled out of control and eventually turned into a violent riot that led to 4 deaths.

Trump's rally and then the rally of his supporters in front of Capitol Hill coincided with the special session held on Capitol Hill. The session, in which both houses of Congress convened to count the electors sent from all 50 states and declare then-candidate Joe Biden the winner of the 2020 election, was interrupted by violence by protesters who broke into the plenum and nearly killed lawmakers. They eventually convened and ratified the Electoral College.

It is also possible that new details will be revealed about his attempt to have Biden's declaration as president-elect rescinded as part of possible counts of sedition and attempted coup.

Trump has already been prosecuted in two other cases. In one, in a New York State case, he is accused of misusing election funds by paying silence money to star Stormy Daniels to keep her from revealing their alleged affair.

In a second federal indictment, he is accused of improperly possessing classified documents at his Florida estate and obstructing an investigation. Smith investigated that case as well.

If he is indicted, it would be a second federal indictment. A final decision is in the hands of a jury convened by the special prosecutor, who will have to consider how much evidence is sufficient to convict.
