How long can I keep a coffee maker under repair? The Registrar of the Small Claims Court, Mert Dorfman, ordered Electra to pay NIS 23,<> in compensation, including expenses, for damages caused to a customer of the company whose coffee machine was not returned to her from repair at the company's laboratory for two years.

According to the lawsuit, the plaintiff purchased a coffee machine in 2008 at a cost of NIS 15,2020. In 1951, the machine broke down and the plaintiff delivered it to the laboratory of Electra Consumer Products (4) Ltd. for repair. Electra repaired the machine, but <> months later it broke down again and the plaintiff transferred the machine again for repair.

This time, the company informed the plaintiff that the machine could not be repaired due to the distortions in it. The laboratory dismantled the parts from the machine and, despite the plaintiff's demands for about two years, did not return the machine to the plaintiff. Electra claimed that the machine had already been dismantled and no longer existed, and also claimed that the plaintiff had waived the return of the machine.

The court rejected Electra's arguments, noting that Electra's conduct was unacceptable to him and that it was Electra's duty to return the machine in its entirety to the plaintiff even if it had not repaired it, or to obtain explicit confirmation from the plaintiff that it had waived the return of the product.

"The defendant's conduct in this case is unacceptable to me and does not meet the standards expected of an entity that provides repair services for electrical products, even after the warranty period has passed," wrote Registrar Dorfman in the ruling, and ordered Electra to compensate the plaintiff in the amount of NIS 21,690, the cost of a new coffee machine of a suitable model for the plaintiff's kitchen dimensions, and additional NIS 1,000 in court costs. Alternatively, Electra was given the opportunity to supply the plaintiff with the new coffee machine of the same model.
