Crime of Morena in Lanús: one of the Madariaga refused to testify and investigate the route of the cell phone stolen from the girl

'Miguelito' is accused of being one of the two motorcycle riders who assaulted and killed the 11-year-old girl at the door of a school in Lanús.


Prosecutor Silvia Bussano, in charge of the investigation into the murder of Morena Domínguez, the 11-year-old girl killed by motorcycles at the door of a school in Lanús, said that the circle of suspicion closes in the brothers Darío Humberto "Lolo" (25) and Miguel Ángel "Miguelito" Madariaga (28).

"After all the investigative tasks that were carried out yesterday, it was possible to determine the identity of the two authors who are detained and today they will receive the statement of inquiry," Bussano said. In that sense, judicial sources told Clarín that "Miguelito" Madariaga refused to testify.

Bussano remarked that "the prosecution has the necessary evidence to prove prima facie that these are the authors of the act."

Asked about the evidence, the prosecutor said that "the keys are several, the cameras helped, but also helped the statements of all the witnesses and all the intelligence tasks that were done to find the whereabouts of these two people."

"In general, in complex investigations like these, there is not a single means of proof, but several means that must be concatenated," he added.

He confirmed that those accused of Morena's death committed a violent assault to steal her belongings and that for that reason "the (criminal) classification is homicide on the occasion of robbery", a crime contemplated in Article 165 of the Criminal Code and which provides for a penalty of 10 to 25 years in prison.

"There was talk at first of the participation of minors. There were those who charged minors. I am a senior prosecutor so if the perpetrators were minors, they would not be talking to me at this time," he told C5N.

In addition, on this point, he added: "There is evidence in the file regarding some statements of the minors, but I cannot issue because they are minors."

In another interview, to Radio Con Vos, and asked if it is true that a 14-year-old teenager claimed responsibility for the crime and then denied being the author, he replied: "To this day that is not in the cause."

And he said that while it is true that "several minors were apprehended yesterday," he clarified that they were "at the disposal of the prosecutor of responsibility" juvenile criminal "but for a fact that has nothing to do with this."

The prosecutor said that "the cameras have been of great help" when it comes to ruling out the participation of the minors indicated and on this, she explained: "The people we saw in the cameras did not coincide with the physical bearing of the minor of whom we also had photos. But beyond that we had many neighbors who were a fundamental part in this investigation."

Bussano also reported that "Morena's cell phone", stolen by the motochorros, "did not appear", that his family was the one who revealed that he did not have an active line and only connected when he had a Wi-Fi network and that he is still checking with the tracking of the phone and the lines if it is true that the criminals went to sell it to the Buenos Aires neighborhood of Once.

"We do not have that certificate, nor that they have gone to sell it to buy paco, nor that they were consuming paco, all that is not certified in the cause. It is true that they are people who are dedicated to crime, it is true that they are consumers, what is not certified is that at that time they have done that, "he said.

The prosecutor also acknowledged that it is true that there is "a high degree of cases" with older defendants increasingly younger and with the participation of minors, but that for her lowering the age of imputability "is not the solution."

"The state must be present everywhere and not only with the police or with justice. We entered when all the rest of the mechanisms that the State offers to society failed," he said.

He also said he "disagreed" with the idea that Justice does not give an answer, and on that, he said: "I believe that we do give answers and it was evident yesterday for example. We do everything to reach positive results, investigations, apprehensions, raids, yesterday there was everything."

"Regarding the defendants leaving through 'the revolving door' is a matter of the laws that we are not the ones who have to modify them, we practice them only," he added.
