A Benediktbeurer is again spared imprisonment despite two open probations. He wanted to steal four small bottles of champagne, but was caught.
Benediktbeuern/Wolfratshausen – Four Piccolos at a total price of 3.96 euros wanted to be taken by a shoplifter on March 28 of this year shortly before 19 p.m. in a supermarket in Benediktbeuern. Now the man, a 37-year-old from the village, has been sentenced to nine months in prison for theft in unity with insult in two cases.

The fact that the sentence was suspended on probation was a great stroke of luck, because the defendant brought two current probations to the trial at the Wolfratshausen District Court, one of which was already for theft. The only thing that saved him from prison was the fact that just a few days after the incident he had gone to long-term inpatient therapy to treat his alcohol addiction.

"I'm an alcoholic," the accused prefaced his statement and admitted that he had pocketed the four small bottles that evening two minutes before closing time. As far as what the prosecutor had read out was true, he contradicted the second part of the indictment. "I didn't insult the two women."
"He yelled: Shut up, you bitch": Shoplifter gets caught
A saleswoman had shouted around, with whom he had discussed, and the word "Kurwa" had certainly been used, he admitted. But that means "damn shit" in his native language. "It's an insult to us," the judge told the man that, to his knowledge, the German translations "hooker" and "whore" were much more common.
However, this was not the end of the encounter between the saleswomen and the shoplifter. "He yelled, 'Be quiet, you bitch. And: Shut up, you bitch," reported the 28-year-old, who had caught the man stealing. A colleague (56) added: "He said something like: Where he comes from, I could get rich as a hooker."

The defendant apologized to both women for his bad behavior. This was all the more inappropriate as he had gotten off with a warning in a similar situation just a few months earlier. "We gave him another chance," the saleswomen explained, explaining why they had not reported the man when he had already pocketed a few bottles of liquor at the checkout. The next day he came and paid for the goods afterwards.

The man, who was already heavily intoxicated when he entered the store, did not do that this time. Instead, he emptied all four bottles "on ex" while waiting for the police in the office with the women. A breath alcohol test showed a value of the equivalent of around three per thousand. Due to his aggressive behavior, they did not dare to prohibit him from drinking, the witnesses explained.

The public prosecutor considered it positive that Benediktbeuren, who had been convicted several times, was always striving to get rid of alcohol. The prosecutor aggravated the sentence by the fact that "the nature of the insults at the lowest level was misogynistic".
This was also emphasized by Judge Helmut Berger in his verdict. He sentenced the former geriatric care assistant to nine months in prison, as requested by the prosecutor, but suspended the sentence "with great concern" for five years. "It's all up to you now. If you can't get your alcohol problem under control, you don't stand a chance," Berger emphasized. "If you continue to commit crimes, the path to prison will certainly lead to this court." (rst)
