The lawyer Gabriela Tomljenovic said that the young woman could have left the house alone, for a sector that the cameras do not capture.

The defense of César Sena, accused of the femicide of Cecilia Strzyzowski in Chaco, questioned the prosecutor's hypothesis about the scene of his wife's crime and raised the possibility that the girl left the house by her own means in a "side door" that the cameras do not take.

The one who made the proposal was the lawyer Gabriela Tomljenovic, who assumed the defense of César this week after the departure of Ricardo Osuna, who was displaced at the request of the prosecutors investigating the case.

Tomljenovic presented his point of view before the Court of Appeals in Criminal and Correctional Matters, which this week deliberated on the request to lift the preventive detentions that César and four other defendants currently have.

According to the lawyer, there is a possibility that the young woman left her parents' house by her own means through a "side door" that the security camera did not capture.

"I invited the Court to look and check the front of the house (of the Sena) which has two gates that each have a pedestrian door with independent opening and the door on the left side is not visible from the camera. Therefore I explained that it could well have happened that she, after a fight in which César had the scratches, could have retreated through that side gate," the lawyer told the Telam agency.

Meanwhile, the Chamber will resolve next Tuesday the confirmation or rejection of the preventive prisons of Sena Jr., accused of "homicide triply aggravated by the link, by femicide and by the premeditated collaboration of two or more people," and of the four detainees for "aggravated concealment."

Also the situation of Gustavo Obregón, Gustavo Melgarejo, Fabiana González and Griselda Reinoso, these four accused of "cover-up". The definition falls on judges Héctor Geijo, Daniela Meiriño and Ernesto Azcona.

On August 4, Judge Héctor Sandoval had already confirmed the preventive detentions of Emerenciano and Acuña.

Why take it home?

For Tomljenovic, the theory of the premeditated plan to kill Cecilia "does not hold up." "If there really was a plan, an agreement of wills since May to kill Cecilia, why would they have chosen as the place to make it their house, which is a place to which many people had access?"

For prosecutors, Cecilia was murdered on June 2 between 12.16 and 13.01, when they were in the house of the clan both César and Emerenciano Sena and Marcela Acuña, her parents. The three would have planned the crime simulating a trip to Ushuaia to take the young woman to the home. This is clear from the request for preventive detention signed by Jorge Cáceres Olivera, Jorge Gómez and Nelia Velázquez,

"Why do it and supposedly leave Cecilia's body at a time when every Friday a person was going to iron? In fact, he was ironing for more than an hour that day. Marcela Acuña herself opened the door and left with Emerenciano Sena, leaving this person ironing. He doesn't find any kind of logic that they left and left that person alone knowing that there was a body in the house," Tomljenovic said.

The lawyer assumed the defense of César because Osuna, the previous lawyer, also took the technical defense of Emerenciano. For prosecutors there is a conflict of interest, since the parents of the young man have slipped that the perpetrator of the crime would be their son. Even his own lawyers mentioned this hypothesis to Clarín.

"The same prosecutor's office has a report from an expert in the field where it is said that the minimum time to burn a body is between six to eleven hours and a maximum of fifteen with permanent fire and they were one hour in the field. Nothing makes sense," he said.

Tomljenovic also referred to the finding of Cecilia's blood in furniture donated by the Sena family that "can give various interpretations such as what Cecilia's doctor stated that in 2019 he consulted for the first time for hypermenorrhea, which is abundant menstrual bleeding. "

"In January of this year he consulted her about the same problem, that is, she had been suffering from this for more than three years. Then the prosecutor replies and says 'ah well all women if they know they have that problem they are going to wear daily protector'. If you have hypermenorrhea, the daily protector is of no use to you," he said.
