Although under the circumstances the petition was allowed, Jerusalem District Court Judge Ilan Sela chose to address the claim of the police officer, who noted in his response that the police have the authority to handcuff a detainee, as long as shackling him does not impede medical operations, and that the purpose of shackling him is to prevent escape or endanger civilians and police officers.

Justice Sela emphasized that contrary to the police's position that: "A detainee should not be shackled to his bed when there is no fear of danger and escape," and added that "in light of the document submitted by Shaare Zedek Hospital regarding the medical condition of the petitioner, who is unable to move, I am not convinced that there is any substance in the respondent's response."
