The defendant and others were involved in a violent lynching during which Mor Janashvili was attacked. The court referred to the circumstances of the incident – Janashvili was traveling in his car and was on his way to visit his mother, who lived near the site of the attack. As he approached the mother's residence, his vehicle was attacked by a hail of stones, he lost control of the vehicle and tried to flee, but the mob – including the defendant – continued to attack him even when Moore collapsed wounded on the ground.
The defendant at that point proceeded to hit Moore with a table leg on his head. The rioters and the defendant stopped beating Mor only after the intervention of Sheikh Abbas, who demanded that they do so.
