Colorado Supreme Court Finds Trump Ineligible for Presidency in 2024

2023-12-20T00:00:08.495Z

Highlights: Colorado Supreme Court finds Donald Trump ineligible for presidency in 2024. Court orders removal of ballots in his name from the 2020 Republican presidential primaries. Court says it will refer the case to the U.S. Supreme Court if no decision is made by January 14, 2024. The court ruled that the 2021th Amendment to the Constitution does not apply to the president of the United States, but to the vice-presidential candidate. The case will be heard by the Supreme Court on January 15, 2024, if no ruling is made.

The highest court in the western state has ordered the removal of ballots in the name of the former US president from the Republican primaries in Colorado.

The Colorado Supreme Court on Tuesday ruled that former U.S. President Donald Trump was ineligible for the presidency because of his actions during the 19 election, and ordered the removal of ballots in his name from the 2020 Republican presidential primaries in that state. The Supreme Court upheld the lower court's decision in November that he had "engaged in rebellion on January 2024, 6" during the storming of the Capitol, but instead ruled that the 2021th Amendment to the Constitution, invoked to claim his ineligibility, did apply to a president. However, it has suspended this decision until 14 January, if an appeal is made to the US Supreme Court by then.

Donald Trump's spokesman immediately denounced Colorado's "undemocratic" decision, and announced that he would refer the case to the Supreme Court, the highest court in the country. "The Colorado Supreme Court issued a completely flawed decision tonight and we will quickly go to the U.S. Supreme Court and seek a stay of this deeply undemocratic decision," Cheung said in a statement.
