He didn't have a driver's license. Nevertheless, a man from Wolfratshausen delivered food for a restaurant - and was caught. That's why the man was now on trial.

Wolfratshausen – Although he had to surrender his driver's license to the district office in the fall of 2022, the defendant probably got behind the wheel of his car several times for half a year. However, the district court was only able to prove one of the alleged 141 trips with which the 54-year-old Wolfratshauser delivered food for a restaurant.

Traffic control brings it to light

On June 21, 2023, the father of two was caught in a police traffic stop. At that time, he wanted to bring food to a Geretsrieder, but could not show a driver's license. "The driver told me he had forgotten about him," a police officer recalled in court. She quickly found out that this was a lie, that his driver's license had been revoked. The following day, the investigator learned from an employee of a restaurant in Wolfratshausen that he was mainly employed there as a supplier. The accused vehemently denied this. "I also do a lot of other jobs there, take orders and work in the kitchen," he said. He even delivered the food by bike because of his revoked driver's license. The trained cook had only driven the car once during the control described above.

The public prosecutor and judge Helmut Berger did not want to believe these statements, but could not provide any evidence of repeated violations. The interrogation of the former manager of the restaurant, who testified as a witness in the trial, also did not contribute to the clarification. It revealed strong gaps in memory and made a similarly confused impression as when it was published in spring 2023. At that time, he had been sentenced to a suspended prison sentence of six months for five counts of intentional violation of the Food Act. In the kitchen of the catering business, an inspector came across spoiled poultry and rotten fish, among other things. This time, however, it was about his employee, who got away with a moderate sentence.

Moderate penalty

Judge Berger imposed a fine of 160 daily rates of 30 euros each – a total of 4800 euros. This includes a sentence for intentional bodily harm because the man's off-leash dog had bitten a neighbor. In total, the defendant had previously been convicted 15 times. His criminal record includes driving without a license, narcotics offenses, fraud, forgery of documents, and trespassing. "They were lucky that the public prosecutor's office did not apply for an isolated blocking period to obtain the driver's license," said Berger.
