The military court on Tuesday submitted a request with the consent of both sides – the military prosecution and the defense team – to release Aviad Freija from house arrest, in accordance with the ongoing investigation.

"We welcome the agreement to release our client from house arrest. This is an obvious decision that speaks for itself," said Frige's lawyers, Shlomi Tzipori and Ran Cohen Rochberger. "The fighter fully cooperated in the investigation from the beginning and agreed to every single action requested to clarify the facts, and of course will continue to do so. We believe that at the end of the investigation, the MAG Corps will also be convinced that reserve fighter Aviad Freija acted in good faith and out of a sincere belief that he is neutralizing one of the terrorists who still endangers him and his surroundings."

According to them, this is not a criminal incident but an operational malfunction and this is how things should be treated. "In the extreme operational circumstances in which he operated, while encountering a terrorist squad face to face, there is no basis for criminal prosecution. Since the tragic death of the deceased, Yuval Castleman, z"l, due to his mistaken identification as one of the terrorists in the attack, our client has been in pain and anguish and sends his condolences to the grieving family."
