The local court ruled on December 19 that the former president's role in the storming of the Capitol on January 6, 2021 and his anti-democratic maneuvers to take away Joe Biden's victory formed "a call for insurrection." To do so, it invoked Article 3 of the 14th Amendment to the Constitution, which excludes persons who participated in an insurrection or rebellion from holding government office. This article had never been invoked against a presidential candidate.
