Attempted stabbing attack in the Old City of Jerusalem, September 5, 2023/Israel Police Spokesperson
The criminal department of the prosecutor's office filed an appeal this morning (Thursday) against the decision of the district court in Tel Aviv to release from custody a 14.5-year-old minor who was charged with attempted murder with a terrorist motive and to transfer him to a closed residence until the end of the proceedings against him.
According to the indictment, the accused, along with another minor, arrived in Tel Aviv last November with the intention of murdering a soldier with knives near the "Terminal 2000" station in the city.
Patrol officers who noticed their suspicious behavior searched their bodies, found the knives and arrested them.
The court decided on the minor's release from custody and his transfer to a locked residence until the end of the proceedings against him.
The prosecutor's office, through attorneys Rachel Mater and Noa Ezra-Rahmani, filed an appeal against the decision to release the minor to daycare: "This is not an alternative to arrest that would respond to the danger posed in light of the nationalist type of crime, and the explosive security situation prevailing in the country."
"He came with the intention of murdering a soldier with knives", an attempted stabbing attack in Binyamin last week/TPS
The lawyers claimed in the appeal: "The act of the minor did not take place as part of a short or one-off event, but rather involved long-term planning and deliberation together with the other for about two weeks. There is something in this act to express boldness, determination and an ideological motive."
The attorney's office emphasizes: "This is not the first time that young boys, and even this defendant, act in the same way, and the risk of these actions has previously increased human lives."
In light of the defendant's actions, the prosecution concluded in its arguments: "The court erred in its decision to release the minor, and requests to accept the appeal and order his detention until the end of the proceedings against him."
